For this day, please identify in which London borough was responsible for the most ULEZ fines. 3. Between Jan 1st 2023 to present day, what are the top 3 London boroughs in which ULEZ fines have been recorded in? My questions relate to the London borough where the vehicle was captured contravening the ULEZ.

Thank you for your request received on 7 February 2024 asking for information about Ultra Low Emission Zone (ULEZ) penalty charge notices (PCNs).
 
Your request has been considered in accordance with the requirements of the Environmental Information Regulations (EIR) and our information access policy. I can confirm that we do hold the information you require. You asked:
 
1.         What are the top 5 roads in London that are responsible for the most ULEZ fines since Jan 1st, 2023, to present day? (in other words, which 5 roads in London generate the highest number of ULEZ fines) –
 
In accordance with the EIR, we are not obliged to supply any of the information as it is subject to a statutory exception to the right of access to information under regulations R12(5)(a) – international relations, defence, national security & public safety (in this instance specifically public safety), regulation 12(5)(b) – the course of justice, the ability of a person to receive a fair trial or the ability of the public authority to conduct and inquiry of a criminal or disciplinary nature – (in this instance specifically the course of justice), and regulation 12(5)(e) – confidentially of commercial or industrial information where such confidentiality is provide by law to protect a legitimate economic interest.

2.         Between Jan 1st 2023 to present day, which day recorded the highest number of ULEZ fines across London?
 
The ULEZ was expanded on 29 August 2023 across London boroughs. Following the launch of the expansion, between 29 August and 25 September 2023, warning notices were issued to owners of non-compliant vehicles who had not paid the ULEZ charge after driving in the zone. Warning notices were issued to ensure the correct action is taken in the future and to allow for any genuine mistakes that may have occurred. Therefore, no PCNs were issued for the entire zone between 29 August and 25 September 2023, we resumed issuing ULEZ PCNs were issued for journeys from 26 September 2023.
 
Between 1 January 2023 and 12 February 2024, the day with the highest number of ULEZ PCNs issued was 27 October 2023 when we issued 8,722 PCNs. It should be noted that 27 October 2023 was during the school half-term holiday which usually sees an increase in volumes issued due to more people driving into the zone.
 
a.         For this day, please identify in which London borough was responsible for the most ULEZ fines.  – 
 
When a vehicle is driven in the ULEZ its registration can be captured by numerous different cameras as it moves through the zone. The system retains the clearest image for use when issuing a PCN that in no way indicates the journey or route the vehicle took. While we record the camera which took the image and the street name, we do not record which London borough it is in.
 
Given the time it would take to assign a borough to each road, for each PCN issued, we are applying Regulation 12(4)(b) to the remainder of the request as we believe to provide this information would be ‘manifestly unreasonable’.
 
The use of this exception is subject to a public interest test, which requires us to consider whether the public interest in applying the exception outweighs the public interest in disclosure. We recognise that the release of the requested information would promote accountability and transparency in public services and may help address your particular concerns. However, the time it would take to provide the information you have requested would divert a disproportionate amount of our resources from its core functions and on balance we consider that the public interest currently favours the use of the exception.
 
3.         Between Jan 1st 2023 to present day, what are the top 3 London boroughs in which ULEZ fines have been recorded in?
