Sexual harassment/assault allegations

Request ID: FOI-3860-1920

You asked

Hi there, I hope you’re well, especially with the coronavirus panic at the moment. Hope things aren’t too hectic on your end! I wanted to make an FOI regarding sexual harassment/sexual assault allegations and complaints within TfL. I’m not sure of the best way to phrase this, so please do let me know if it would be more useful to use different terms. If possible, I would like to know the below information, covering the most recent four year period: • How many allegations of sexual harassment/assault/misconduct have been made against employees or staff of TfL? • How many claims of unfair treatment (relating to gender or sexual harassment) under the equality act were made against employees or staff of TfL? • Details of how the above two bullet points were resolved – for example, how many were referred on to an employment tribunal, or to police? How many resulted in warnings or termination of employment? • What is TfL’s official guidance for dealing with allegations of a sexual nature, both in offices and on sites? How are they dealt with, for example, on construction sites involving subcontractors? I hope I’ve phrased that in a way that’s clear, but please do give me a call or send me an email if you want to discuss this or need me to provide any other info. Also, if you can only answer some of the info/provide info for a shorter time period I would still really appreciate that too. Thank you! All the best and take care,

Our Ref:         FOI-3860-1920

Thank you for your request received on 13 March 2020 asking for information about sexual harassment/assault allegations at TfL.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm we do hold the information you require.

A copy of our Code of Conduct as well as our Disciplinary Policy is available on our website:

In accordance with section 21 of the FOI Act, we are not obliged to supply you with a copy of the requested information as it is already accessible to you elsewhere.

Unfortunately, to provide the remainder of the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

We have estimated that it would cost in excess of £450 to provide a response to your current request. This is because it is estimated that it would take over 18 working hours to retrieve and compile the information you have requested.

We do not record the information you have requested centrally. In order to collate the requested information we would have to look at all of the cases there have been of sexual harassment and / or bullying at work. There have been over 230 such cases in the requested period. We would need to individually review each allegation to determine whether they were captured by your request and the outcome of the case.

To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. For example, by narrowing the time limit.

Although your request can take the form of a question, rather than a request for specific documents, TfL does not have to answer your question if it would require the creation of new information or the provision of a judgement, explanation, advice or opinion that was not already recorded at the time of your request.

Please note that we will not be taking further action until we receive your revised request.

In the meantime, if you have any queries or would like to discuss your request, please feel free to contact me.

Please also note, the Government has announced a series of measures to tackle the coronavirus. It is essential for London, and in particular for all critical workers, that we continue to provide a safe transport network that enables them to make the journeys they need to.

In current circumstances, we are not able to answer FOI requests readily and we ask that you please do not make a request to us at present.

Answering FOI requests will require the use of limited resources and the attention of staff who could be supporting other essential activity. In any event, please note that our response time will be affected by the current situation.

Please see the attached information sheet for details of your right to appeal.

Yours sincerely
