Thank you for your Freedom of Information request received by Transport for London (TfL) on 13th March 2019 asking for information about BMW motorcycles granted an exemption from the Ultra Low Emission Zone (ULEZ).

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.

I can confirm that we hold the information requested. However, to provide the information would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, and then locating, retrieving or extracting it from other information, would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

When we update a vehicle record to make it compliant with ULEZ we do not record the make and model of the vehicle being updated. We do however record the vehicle registration. Since 1st January 2019 we have updated 1800 vehicle records. To identify the make and model of the vehicles, and obtain any accompanying Certificate of Conformity, we would need to access each individual enquiry which led us to update the record. Accessing and verifying an enquiry would take an estimated 4 minutes. Therefore checking 1800 records would take approximately 7200 minutes, which equates to 120 hours – well in excess of the 18-hour threshold to which £450 equates.

To help bring the cost of responding to your request within the £450 limit you may wish to consider narrowing its scope, bearing in mind the advice above.
