Taxi fines/court costs

Request ID: FOI-3328-1819
Date published: 01 April 2019

You asked

Hi, I want to know the total amount of fines issued to taxis, broken down by Hackney Carriages and Private Hire Vehicles if possible. I want to know the total amount of court costs incurred in pursuing offences in the courts of taxis, broken down by Hackney Carriages and Private Hire Vehicles if possible. I want both of these broken down by month and by the smallest possible area from the beginning of 2015 to the most recent possible data. Thanks

Thank you for clarifying your request.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

Unfortunately, although you have refined your request again, we are still unable to answer this without exceeding the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with requests if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. In this instance, we estimate that the time required to answer your request would exceed 18 hours which, at £25 per hour (the rate stipulated by the Regulations), exceeds the ‘appropriate limit’.

Our records are not kept in a way which will readily allow us to provide the specific information you have requested. We would firstly need to identify those cases which relate to the violations you have requested, and then look into these actual cases to provide you with the detailed information. The fines/costs is what was awarded by the court not “incurred in pursuing offences” – if an individual is convicted we ask the court for costs and the court decide the amount they will award.  Fines are not ‘gained’ by TfL – these are courts monies. Therefore the information you have requested would not be identified clearly in each case, and would therefore take some time to compile these details.

To help bring the cost of responding to your requests within the £450 limit, you may wish to consider refining your requests to concentrate on matters which are important to you.

If you are not satisfied with this response please see the attached information sheet for details of your right to appeal.

Yours sincerely
