Thank you for your request received by Transport for London (TfL) on 16th November 2023 asking for email correspondence between various TfL staff. Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“Email correspondence: Could you please supply all email correspondence(s) containing the name xxxx / xxxx / xxxx sent & received by the following TFL employees email address accounts below. From 30th Oct to todays date xxxx & xxxx”.
I am afraid that the requested information is exempt from disclosure under section 40(2) of the Freedom of Information Act, the exemption that protects against the unfair release of personal data. Under section 40(2), information is exempt from release if it relates to an identifiable third party and if release is considered to be unfair. In this case, with individuals named in the request, the information clearly relates to identifiable third parties. The question therefore is whether release of the material would be fair. We do not believe that the individuals involved would expect that email correspondence between them would be divulged in this way, and we therefore conclude that release would be unfair.
