Thank you for your request received on 28 March 2022 narrowing your request for information about the prosecution of minicab drivers for refusing to carry assistance dogs.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require. You asked:

Would it be possible to know among the 19 successful prosecutions in 2021 (to December 15) how many concluded with the loss of the driver's licence?

In addition to the penalties imposed by the courts, which can include a conviction, fines and a requirement to pay TfL’s legal costs, we will consider whether appropriate licensing action is taken; this will depend on the circumstances of the case and the driver’s previous compliance and complaint history.

Licensing action includes warnings, a licence suspension or the revocation of a licence. Of the 19 drivers who were successfully prosecuted for Equality Act offences, 12 had their licence revoked and a further driver had their licence renewal refused. Of these, three drivers successfully appealed the licensing decision via the Magistrates courts. We issued these drivers with written warnings. A further two appeals are pending and will be considered by the courts.

Four drivers have had their licence suspended or a warning issued. We are also considering licensing action against two drivers.
