Oyster Lending

You asked

Number of people who caught using an Oyster card not registered to them which had one of the following on it: Travelcard or Bus & Tram Pass season ticket Jobcentre Plus Travel Discount Bus & Tram discount National Railcard discount Disabled Persons Railcard discount. Could I have this data broken down by year (for the past five years or financial years if costs permits) and then further broken down by what the oyster card had on it in terms of pass or discount. Could I then find out what the total fines were for these people, broken down by year. What is the maximum fine for using or lending an oyser card with one of these things on it?

Thank you for your email received by us on 10 January 2018 asking for information about Oyster Lending.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

Unfortunately we do not hold the information you have requested as offences of fare evasion are not recorded by pass type on our Mercury enforcement database.

The maximum fine that may be imposed by the Magistrates Court for an offence of fare evasion is £1,000.  The Magistrates Court consider a defendant’s ability to pay when imposing fines.

Each case is therefore reviewed on it’s own merits in accordance with Sentencing Guidelines.
