Thank you for your request received by Transport for London (TfL) on 22nd January 2023 asking for information about expanding Pay As You Go.
 
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.

Specifically you asked:

Can you publish the appendices from the report, which is:

Appendix 1: Proposed station list
Appendix 2: Proposed expanded PAYG area map (in high quality PDF format, if possible)
Appendix 3: Exempt supplementary information”.

I can confirm that we hold the information you require.

In relation to Appendices 1 and 2, this information is exempt from disclosure under section 22 of the Freedom of Information Act, which can apply when information is ‘intended for future publication’. This information is to be published by the Department for Transport at a future date and therefore the exemption is engaged. Section 22 is a ‘qualified exemption’, meaning we have to consider whether the greater public interest rests in the exemption applying and the information being withheld, or in releasing it in any case. We appreciate the need for openness and transparency in the running of our business, and the fact you have requested the information is in itself an argument for release. However, the Department for Transport has requested that the information is not published at the current time, and we do not see an overriding public interest in us ignoring that request and pre-empting the publication. We therefore believe that the exemption should apply, and that the information should be published in context and according to the predetermined schedule.

In regard to Appendix 3, this document contains detailed financial information about the project that would prejudice the tendering process should it be released. The information is therefore exempt from disclosure under section 43(2) of the Freedom of Information Act, the exemption that applies where release of information would prejudice commercial interests. Again, this is a qualified exemption. Given that the Department for Transport is a publicly funded body, we see no overriding public interest in releasing information that might prejudice negotiations and add costs to the public purse.
