Under the Foi act I would like the following information: Name, title, email address and direct telephone number of all TfL employees whose basic salary is over £40,000. Please exclude drivers of trains.

Thank you for your request received by Transport for London (TfL) on 7 December 2017 asking for information about employees salaries.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy.

I can confirm that we do hold the information you require. However, we are not obliged to provide you with the personal information that you have requested as it is subject to a statutory exemption to the right of access to information under the Data Protection Act 1998 (DPA), as required by section 40(2) of the FOI Act.

This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose any of the requested personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

Information relating to senior staff earning in excess of £50,000 can be found on our website here: http://content.tfl.gov.uk/tfl-senior-employee-salaries-2016.pdf , however, the personal information requested, i.e. name, email address and direct telephone numbers is not available.
