Thank you for your request received by Transport for London (TfL) on 7 November 2024 asking for information about Statutory Declarations for ULEZ PCNs.
Your request has been considered under the requirements of the Environmental Information Regulations and our information access policy. I can confirm that we do hold the information you require.
On receipt of an Order for Recovery a motorist has the right to submit a Statutory Declaration to the Traffic Enforcement Centre (TEC). The declaration is then considered by the TEC.
If a Statutory Declaration is accepted by TEC and was made on ground 1, "You did not receive a PCN", we will reissue the PCN allowing the motorists to pay or make a representation.
1. Number of Statutory Declarations submitted, after Order of Recovery issued, on grounds that original PCN/s not received within 14 days and requesting discount rate applied, in 2023 and 2024.
2. Number of the Statutory Declarations submitted on grounds of not receiving PCNs within 14 days were successful to be reduced to the original discounted rate.
Statutory Declarations are not made on the grounds that the PCN was not received within the 14-day discount payment period, just that it was not received.
You have clarified that this request relates only to PCNs issued for ULEZ.
From 1 January 2023 to 19 November 2024, TEC accepted 14,190 Statutory Declarations on ground 1 - You did not receive a PCN.
Over the same period this resulted in 14,170 PCNs being reissued. In instances when the PCN wasn’t reissued it will have been cancelled, usually due to a processing error or mitigating circumstances.
3. What categories/reasons were submitted in Statutory Declarations for not getting PCNs within 14 days discounted period, and of them the percentage of successful applications.
Statutory Declarations are considered by TEC not TfL and therefore we do not hold this information.
