Our ref: FOI-2135-2122/GH
Thank you for your request received by Transport for London (TfL) on 15 December 2021 asking for iBus Training Software.
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy.
I can confirm that we do hold the information you require, however the training is not provided on a CD. It is software that has been loaded onto our training PC’s by the supplier. In accordance with the FOI Act, we are not obliged to supply this training material as it is subject to a statutory exemption to the right of access to information under section 43(2) - Commercial Interests.
In this instance the exemption has been applied as disclosure of the training material you have requested is copyrighted by the training provider and is not the intellectual property of TfL. The training provider retains the intellectual property rights of the training material. Any unauthorised use of their data may result in our permission to use their material being withdrawn, which would impact our ability to deliver key services.
The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance the public interest is outweighed by the legitimate commercial interests of the training provider.
If you are not satisfied with this response please see the attached information sheet for details of your right to appeal.
Yours sincerely
