I would like to submit a FOI request for the following information:
A breakdown since 2010 for each financial year, of the cost to TfL (excluding legal fees) of compromise and settlement agreements broken down by Directorate.

Thank you for your request received by Transport for London (TfL) on 31 October 2017 asking for details of the cost to TfL (excluding legal fees) of compromise and settlement agreements broken down by Directorate by financial year since 2010.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.
Therefore please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) we are withholding this personal data as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’. In order to answer your request as it stands we would need to redact around half of the figures you have requested, because for any instance where there is only one person in a particular Directorate for one financial year then the cost can be linked to that individual and the amount they received can be determined. Similarly, where there is two people in a Directorate for a particular year then they both know what they personally received so would again be able to calculate the amount received by the other individual. Additionally, the disclosure of the remaining data would limit what we could release in future, because of the mosaic risks of re-identification (i.e. if we keep answering requests on the same data set it can become straight forward to identify individuals from piecing together the parts of the information released).
