7.12.20 clarification: Thank you for your email regarding my request. I am asking for a noise impact assessment for the works that took place during the period I specified in my original email. I understand a risk assessment takes place before major works and that in view of the length of time and the nature of the work that an impact assessment should have been carried out to ascertain what impact the works would have had on the community in relation to the working hours and the noise. I trust that you will find the above in order but feel free to come back to me with any other information you require and hopefully that this will be sufficient information for you to carry out my request. Therefore, please could you provide me a copy of the impact assessment for the works on Birkbeck Tram Stop to Harrington Road line that took place from 21st August until 2nd October 2020.

Thank you for your clarified request received by Transport for London (TfL) on 7 December 2020 asking for information about a noise impact assessment for the works on Birkbeck Tram Stop to Harrington Road line that took place from 21st August until 2nd October 2020.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy.  I can confirm that we hold the information you require.

Please see attached the Section 61 approved application and council consent for works at Love Lane Project on TramLink network site you’ve asked about. This application includes an assessment of the noise to be generated by the track maintenance work along with the mitigation measures to be employed to reduce noise and vibration by best practicable means, and is the mechanism by which the Local Authority consents to work outside of normal working hours.

Please note that in accordance with TfL’s obligations under the Data Protection legislation some personal data has been removed, as required by Regulation 13 of the Environmental Information Regulations. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of the legislation, which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 which would make the processing ‘fair’.
