I am writing to obtain the following information under the Freedom of Information Act. I would like copies of all letters where Cross Rail 2 or TFL acting for Crossrail 2 have objected to any Local Planning Authority in relation to any planning application for any form of residential development that was outside the current safeguarding zone set by the Secretary of State for Transport on the 24th March 2015.

Thank you for your request received on 1 October 2017 asking for information about Crossrail2.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy.  I can confirm we do hold the information you require.

There have been five cases where Transport for London (TfL) has made a representation to the Local Planning Authorities in relation to residential developments outside of the current safeguarding directions, issued March 24 2015.

These cases are below. Copies of the letters sent to Local Planning Authorities can be found in the attached PDF document.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been removed, as required by regulation 13 of the EIR. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.

Whenever a planning authority receives an application in close proximity to the safeguarded directions we encourage applicants to discuss their plans directly with us.

Severance of a parcel of open green space land and the erection of a pair of semi-detached houses with associated parking. Spelthorne Borough Council.

Status – refused permission on residential amenity grounds

17/14178 : 5-29 Coombe Road, New Malden (p.3-4)
Demolition of existing buildings to enable the erection of two mixed use buildings providing 748sqm of retail and 329sqm of office space at ground floor level, 80 flats and 5 town houses, with associated amenity space and basement parking. Royal Borough of Kingston Upon Thames.
Status – application currently under consideration

16/P1208   579-589 Kingston Road, Raynes Park, London SW20 8SD (p.5-6)
Demolition of existing buildings and redevelopment of site to provide offices (1201 sq.m - class B1) and residential (110 units - class C3) accommodation in buildings of two - seven storeys, provision of car parking (21 cars, 12 disabled spaces), cycle parking (218 spaces), vehicle access, landscaping, plant and associated works. London Borough of Merton.

Status – application currently under consideration

17/P0061 : 2 Merton Hall Road Wimbledon Chase SW19 3PP (p.7-8)
Demolition of garage and erection of a new end of terrace, two storey dwelling house with Juliette balcony to rear roof extension. London Borough of Merton.

Status – refused permission on residential amenity grounds and because the site had been identified by TfL as a future worksite for Crossrail 2 it would be contrary to the Council’s polices on public transport and transport infrastructure.

17/P0609 : Land on south side of Wyke Road from pedestrian tunnel eastwards towards south west corner of 87 Stanton Road. Wyke Road Raynes Park London (p.9-10)
Construction of three apartment blocks (two three storey blocks and one four storey block containing 10 x one bedroom flats. London Borough of Merton.
