I work for Cambridgeshire County Council and we are currently constructing Ely Southern bypass. As part of this scheme we are investigating the installation of height restriction barriers/freestanding collision protection beams (CPB) on approaches to low structures. I understand that there are height restriction barriers/freestanding collision protection beams (CPB) on the approach to a structure on Carpenters Road, Stratford, E15 2JH (Network rail ref. Carpenters Road LTN1/58 at 3m 56ch). From previous communication we understand that the installation of this structure was initiated from, designed by and the installation managed by Docklands Light Railway following receipt of agreement from the London Borough of Newham. Please could provide a copy of the process through which this was installed, including, but not limited to the Approval in Principle (AIP) from the relevant Highway Authority, any design/construction drawings, the contact details of the fabrication/supplier and the contact details of the installation company. If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under the Section 16 obligations of the Act, as to how I can refine my request.

Thank you for your request received by Transport for London (TfL) on 13 September 2018 asking for information about the structure on Carpenters Road, Stratford, E15 2JH (Network rail ref. Carpenters Road LTN1/58 at 3m 56ch. I sincerely apologise for the delay in replying.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.  You asked: Please could provide a copy of the process through which this was installed, including, but not limited to the Approval in Principle (AIP) from the relevant Highway Authority, any design/construction drawings, the contact details of the fabrication/supplier and the contact details of the installation company.

The design went through the relevant DLR and Newham Council Assurance Processes. Please find attached our Business Critical Process for change Assurance (BCP 14). The LB Newham have their own process aligned to the Section 50 notice. Please contact them for further information at https://www.newham.gov.uk/Pages/Services/Freedom-of-Information.aspx.

As part of the approval process a number of site meetings with both Newham Council and the appointed Contractor, were undertaken to discuss and agree the location of the gantry as well as the design requirements. Throughout the process, Newham Council were kept informed of design progress and were also invited to comment on the options.

In accordance with the FOI Act, we are not obliged to supply some of the information as it is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied as the disclosure of the detailed measurements of the drawings (designed specific to our needs) would, or would be likely to prejudice our commercial interests.

Suppliers or designers may be reluctant to work with TfL on projects in the future if they know that their design drawings may be disclosed under FOI to their competitors; disclosure of the drawings could hinder the ability of these companies being able to competitively tender for similar contracts in the future as well as hinder TfL’s ability to negotiate the best value for money for similar services in the future.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

Please note that in accordance with TfL’s obligations under Data Protection legislation some personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
