Thank you for your request received by Transport for London (TfL) on 19th October 2021 asking for information about Tesla vehicles and the Congestion Charge.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“Please can you advise how many Tesla vehicles TFL has issued PCN’s to for driving within the Congestion Zone during 2021 despite them being 100% exempt EV’s by definition?
Can you also advise how many appeals were made against these PCNs and whether any were successful?”
The Congestion Charging ‘Scheme Order’, the legal document which outlines how we must run the Congestion Charge, states that electric vehicles are 100% discounted from the Congestion Charge under the Cleaner Vehicle Discount (CVD). This is subject to registration with us and an annual renewal. A copy of the Scheme Order is available online at https://content.tfl.gov.uk/consolidated-scheme-order-may2019.pdf
If the vehicle is not registered with us and is used in the zone, during charging hours, a penalty may be issued. In the interest of fairness if a motorist incurs a first penalty in a vehicle which is entitled to the CVD 100% and submits a representation to us we will cancel the penalty and advise the motorist of the registration process.
In the calendar year 2021 up until the date of your request we issued a total of 1,634 penalties to Tesla vehicles.
In order to challenge a penalty the recipient must first submit a representation to us. If the representation is accepted the penalty is cancelled. If we reject the representation the motorist has a further right of appeal to an Independent Adjudicator at London Tribunals.
Of the 1,634 PCNs issued, we received 677 representations. 609 were accepted, 29 rejected and 39 remain open.
Of the 29 rejected representations we received 10 appeals. Of these 3 were refused and 7 remain open.
