Thank you for your request received on 14 September 2022 asking for information about the consultation on proposals to expand the Ultra-Low Emission Zone (ULEZ) London-wide. Your request has been considered in accordance with the requirements of the Environmental Information Regulations (EIR) and our information access policy. I can confirm we hold some of the information you require. In accordance with the EIR, we are not obliged to supply some of the information as it is subject to a statutory exception to the right of access to information under Regulation 12(4)(d).
In this instance the exception has been applied as we are in the process of preparing a Report to the Mayor which will include information on responses to the consultation which the Mayor will consider when he decides whether or not to confirm the Mayor Transport Strategy (MTS) revision and other proposals, including London-wide ULEZ (with or without modifications) in due course. Information on the communication we had with stakeholders and advertisements, will be published on our consultation page in the Report to the Mayor (www.tfl.gov.uk/clean-air) once the Mayor has made his decision later on in the year. We will notify all respondents once the report has been published and have also added you to the distribution list.
This exception is subject to a public interest test, which requires us to assess whether the public interest in applying the exemption outweighs the public interest in disclosure. In this instance, it is considered that the public interest favours the publication of this information, in context and according to the pre-determined schedule, rather than in response to your request, to ensure the information is provided accurately and in an accessible manner. In addition, we held six workshops in March 2022, to gather stakeholders views on what they thought could be the negative and positive impact of the proposed ULEZ expansion London-wide. The findings from these workshops were included in the Integrated Impact Assessment (IIA) which was published as part of the relevant information for the consultation.
