I would like to make a FORMAL REQUEST FOR INFORMATION – as per the Freedom of Information Act and INSPIRE regulations. Please can you let me know the following information 1. The number of penalty notice that you have served for ULEZ since it started in April 2019 2. The number of Congestion Charge penalty notices that you have served in the same period 3. The number of appeals that have been made to you regarding both of the above (given as two separate numbers) 4. The number cases that have gone onto the London Tribunals process in each case.

FOI Request – Penalty Charge Notices (PCNs)

Thank you for your letter received on 2 August 2019 asking for information about Congestion Charge and Ultra Low Emission Zone (ULEZ) PCNs.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require. You asked for:

1. The number of penalty notice that you have served for ULEZ since it started in April 2019
2. The number of Congestion Charge penalty notices that you have served in the same period

As the ULEZ scheme was new, between 8 April and 10 May we issued warning notices rather than PCNs. The table below details the number of PCNs issued for non-purchase of the daily ULEZ charge and non-purchase of the daily Congestion Charge between 8 April and 2 August 2019.

Our process is that we issue PCNs when we have reason to believe a contravention occurred. However, should a driver believe the PCN was issued incorrectly they can challenge the PCN. The first step to challenging a PCN is to make a representation to us. Each challenge is considered on a case-by-case basis, including any mitigating circumstances and this will be either accepted or rejected. If rejected, the next stage is to lodge an Appeal to the Independent Adjudicator.

The below table, shows how many representations were made to us and how many we accepted and how many Appeals were lodged against the rejected representations and subsequently allowed for each scheme between 8 April and 2 August 2019.
