Thank you for your request of 22nd October 2020 asking for information about three Penalty Charge Notices (PCNs) recently issued to you.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

Specifically you asked:

I have been issued with 3 pcns for a vehicle that I do not own or have hired, I have been told someone has provided a hire agreement in my name for this vehicle fraudulently. Can you please provide me with who has provided this information, the name of the company and any contact details for them, and any other information you hold in regards to these pcns.

I am afraid that under section 40(2) of the Freedom of Information Act third party data (i.e., data relating to somebody other than yourself) is exempt from disclosure if somebody can be identified from that data, and where such identification would be unfair. The Information Commissioner’s guidance on the use of section 40 can be found here:

As you can see, there are particular sensitivities around the release of data relating to the alleged commission of criminal offences. Note further that information released under FOI is considered to be to the world at large, rather than to the individual applicant.

For these reasons the information is exempt from disclosure. However, that said, I have passed your communication over to our Road User Charging team for their information. I understand from that team that you have made representations against all three PCNs and that those representations are currently being considered. You should receive a response from Capita advising you of the outcome in due course.
