Please send me copy of the following documents listed below that related to the contravention “Traffic Management Orders (TMO)” & “The Greater London Congestion Zone Charging Order 2006 as varied” for the road sign “Non Payment of Ultra Low Emissions Zone Charge” on the alleged contravention location that you will rely upon in order to enforce this PCN.
6. Copies of the initially published a draft order giving details of the proposed scheme. This draft is sent to the statutory consultees. Please provide a copy of a statutory consultees.
7. Copies of the advertisement placed in the London Gazette and at least one local newspaper. The advertisement must state how to make an objection against the proposals. • Copies of the notices placed on street furniture such as street lights. This will normally be only in the streets affected by the proposals.
8. After publication of the advertisement (see above) there is a period of 21 days in which anybody lodge an objection against the published proposals. If there were objects, please send us copies of it.
9. Copies of the draft orders should be available at the authority's offices and libraries in the areas affected.
10. If there are no objections then the authority will adopt the TMO and place an advertisement in the local paper. Copies of the adverts confirming the adoption of the TMO placed in the local paper.
11. Finally, please send me copies of all the “Traffic Management Orders (TMO)” for all the road signs situated on on the alleged contravention location.

Thank you for your request received by us on 31 August 2021 asking for information about Congestion Charging (CC) enforcement. Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold some of the information you require.
Your questions and our replies are as follows:

We enforce the Congestion Charge (CC) using a network of Automatic Number Plate Recognition (ANPR) cameras, not by CCTV, therefore these cameras are not subject to this type of certification. The requirements relating to devices used to enforce the CC are set out in Article 6 of the The Road User Charging (Enforcement and Adjudication)(London) Regulations 2001, as amended. These are automatic cameras which are not controlled by an operator and there is no video recording, logs, scripts or notes. The cameras capture images of vehicles as they enter, exit or drive within the zone which are only retained for the purposes of issuing a PCN. Images are included in the PCN and can also be accessed via the View a PCN page on our website. There is no requirement that signs must be visible in the images.

The process you have described above relates Traffic Management Orders (TMOs). We do not hold any of the information requested because the CC is governed by a Scheme Order (the Central London Congestion Charging Scheme Order) made under s295 of the Greater London Authority Act 1999, not by the making of a TMO. In line with the requirements of the 1999 Act, implementation of the scheme was subject to full public consultation. Road signs are governed by the Traffic Signs Regulations and General Directions (TSRGD), not by TMOs. All of our CC signs are fully compliant with the TSRGD
