You asked

Hello I hope this finds you well. I am seeking the internal report into the Jubilee Line service which traveled with a number of its doors open between Finchley Road and West Hampstead on 1 September 2018. Please can you provide it. Furthermore, what was the outcome of any disciplinary proceedings against the driver and was there any subsequent punishment?

Thank you for your request received on 15 July 2019 asking for information about the open door incident on the Jubilee Line in September 2018.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.

Please find the requested report attached. We have completed an internal investigation on this incident and worked with the Rail Accident Investigation Branch during their investigation. We have reviewed our procedures and will continue to do so in order to ensure that the Tube is as safe as possible. The safety of our customers and staff is always our top priority.

In accordance with our obligations under Data Protection legislation, information on the outcome of any disciplinary proceedings or subsequent action against the driver has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
