Dear Freedom of Information, I am writing to seek information under the Freedom of Information Act 2000. I am seeking to obtain a copy of a report drawn up by PA Consulting for TfL analysing the root causes of the misoperation of ATP (Automatic Train Protection) equipment. For the purposes of helping you to locate this document, the work was carried out under a contract which has the reference number TfL93514. Please could you send me a copy of this document. Please confirm receipt of this request and provide this information in electronic form within the required 20 working day maximum deadline for FoI responses.

Thank you for your email received by us on 4 August 2017 asking for a copy of the ‘Automatic Train Protection ‘ATP’ Safety System Code Detection Module Code, Root cause analysis and potential solution’ report produced by PA Consulting for Transport for London (TfL).

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. We do hold the information you require.

In accordance with the FOI Act, we are not obliged to supply any of the information as it is subject to a statutory exemptions to the right of access to information under the following sections:

Section S41 – Information provided in confidence; the report contains technical information provided in confidence and releasing this information would be an actionable breach of that confidence. Whilst we recognise that there will be a level of interest given the subject matter, the public interest in disclosure would not be sufficient to avoid an actionable breach of confidence.

Section 38 - Health and safety; in this instance the exemption has been applied as disclosure of the information you have requested contains detailed explanations of our operational systems together with various circuit diagrams of, for example, signaling, and disclosure of this information could adversely affect the safety and security of TfL employees and members of the general public. This information could potentially be obtained and utilised by individuals who may wish to use this information to cause disruption or harm to the London Underground network given that it could affect the safety and reliable operation of the Central Line.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance the public interest in applying the exemption, in order to minimise risks to operational resilience, safe operation of the London Underground network and the welfare of staff and members of public, outweighs the public interest in disclosure.
