Thank you for your request received on 11 September 2020 asking for information about the KPMG report into TfL’s financial sustainability.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.
In accordance with the FOI Act, we are not obliged to supply the information requested as it is subject to a statutory exemption to the right of access to information under section 41 – information provided in confidence.
The KPMG report was commissioned by the Department for Transport who will have a full copy of the report. A provisional, sample copy of a draft of the report has been provided to us by the Department for Transport (DfT) on the basis of an understanding that it would be held in confidence and not circulated for wider distribution. Disclosure of the information requested would constitute a clear breach of that confidence at a time where we are in complex negotiations with the government relating to future funding.
We therefore consider that the information possesses the necessary quality of confidence and our breach of that confidence is likely to be actionable and as a result consider the exemption to be sufficiently engaged.
This exemption is an absolute exemption, which is not subject to an assessment of whether the public interest favours application of the exemption.
