Thank you for your request received by Transport for London (TfL) on 2 September 2020 asking for information about Penalty Charge Notices (PCNs).

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

How many PCNs have been issued for parking contraventions at 176-178 Clapton Common in the last year?

From September 2019 – September 2020, 133 PCNs were issued at this location.

How many were challenged on appeal and how many appeals were successful (both in representations and independent London adjudication)?

In order to challenge a penalty the recipient must first submit a representation to us. If the representation is accepted the penalty is cancelled. If we reject the representation the motorist has a further right of appeal to an Independent Adjudicator at London Tribunals.

For this time period we have received 35 representations against the PCNs issued. Of these 13 have been rejected, 14 have been accepted and 8 are awaiting a decision. Of the 13 representations which were rejected 2 appeals have been made to London Tribunals and both were non contested by TfL.

How much money has Transport of London raised from issuing these particular PCNs?

TfL has received £6,984 in revenue from payments towards these PCNs.

How much has it cost TFL to defend these PCN’s when appealed by the receiver (both in representations and in independent London adjudications)?

We are not obliged to provide you with the costs for dealing with a representations and appeals as it is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the section 43(2) exemption has been applied as disclosure would, or would be likely to prejudice our commercial interests. This work is carried out by Capita on TfL’s behalf. Disclosure of the price TfL currently pays would hinder our ability to negotiate the best value when the contract is retendered in the future.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, particularly where the expenditure of public money is concerned, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.
