You asked

Would you advise the date the London cab order 2012 was communicated to and put into the public domain and state the means employed to make the content of the order known and available to the public. (please give specific details and state how the public could have had access to it.), Would you also advise of any circulars /information letters sent to taxi drivers specifically citing "London Cab Order 2012" and advising them where they might have access to the order itself.

We answered

Thank you for your email received by us on 16 July 2017 asking for information about the London Cab Order 2012.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You asked for the following:

Would you advise the date the London cab order 2012 was communicated to and put into the public domain and state the means employed to make the content of the order known and available to the public. (please give specific details and state how the public could have had access to it.),

Would you also advise of any circulars /information letters sent to taxi drivers specifically citing "London Cab Order 2012" and advising them where they might have access to the order itself.

The introduction of the taxi driver identifiers as included in the London Cab Order 2012, was first announced via Taxi and Private Hire Notice (TPH) 12/11, which was issued on 21 December 2011. A copy of this notice is attached.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

When taxi drivers were issued with their identifiers, they also received the attached letter and guidance notes. The guidance notes made specific reference to Section 28A and states: “TfL has now issued a Cab Order to implement the measure which comes into force on 1 March 2012. From that date you will be required to display the identifiers as a condition of your driver’s licence. Failure to do so, or displaying identifiers that bear a different number to your badge, will be a breach of paragraph 28A of the London Cab Order 1934 (as amended by the new Cab Order). If the breach is repeated then TfL has the power to take disciplinary action to suspend or revoke your taxi driver’s licence”.
