Further to recent correspondence with a senior surveyor from your team I would like to request evidence of Tradeteam's rights in relation to the Silvertown Tunnel Order 2008. We have been told that there is correspondence dated 2015 between TFL and Tradeteam, however when directly requesting this we were advised that TFL do not hold evidence of the correspondence. However we were previously advised that due to data protection restrictions we were not able to retrieve this information, albeit they are a client. We would like to formally request a copy of correspondence with the Port of London Authority in 2015 identified that Tradeteam Limited have statutory rights granted under section 66 (i)(g) Port of London Act 1968 to enable licences to enjoy benefits of a works licence for 2229mm outfalls on Alexandra Wharf.

Thank you for your email received by Transport for London (TfL) on 29 June 2018.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require. You asked:

I would like to request evidence of Tradeteam's rights in relation to the Silvertown Tunnel Order 2008.

The only evidence we hold is the attached paragraph from the Land Interest questionnaire filled out by the Port of London Authority (PLA).  Please scroll down to the bottom of the page.

We would like to formally request a copy of correspondence with the Port of London Authority in 2015 identified that Tradeteam Limited have statutory rights granted under section 66 (i)(g) Port of London Act 1968 to enable licences to enjoy benefits of a works licence for 2229mm outfalls on Alexandra Wharf.

We do not hold any emails with the PLA from 2015. Attached are copies of emails between the PLA and Mouchel Consulting, acting on TfL’s behalf, from March & April 2016.

Please note that in accordance with TfL’s obligations under Data Protection legislation some personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
