Thank you for your letter received on 13 June 2018 asking for information about complaints and parking appeals received about the parking bay at O/S 750-768 BATH ROAD TW5 (EZ ref 12281_00019_RB).
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold some of the information you require.
We do not record complaints data specific to location. However, please see below a table which explains how many Penalty Charge Notices (PCNs) were issued to vehicles stopped in the red box outside 750-768 Bath Road when prohibited for the last three financial years.
We issue PCNs when we have reason to believe a contravention occurred. Should a driver believe the PCN was issued incorrectly, they can challenge the PCN; all PCNs are subject to a statutory representations and appeals process and each challenge is considered on a case-by-case basis, including any mitigating circumstances. We have the discretion to cancel a PCN or refund all or part of a PCN payment for any reason, however this would not mean the PCN was issued incorrectly. If a representation is rejected, the driver is within their rights to appeal to an independent adjudicator. Should a driver pay a PCN and later have their representation accepted or appeal allowed, any payment will be refunded. Representation and appeal outcomes are also detailed in the below table.
