You asked

This request under the Freedom of Information Act relates to the part of the A316 Feltham highway up to and including 100 metres east and 100 metres west [the “Location”] of the Crispen Road bus stop layby [the “Layby”]. Please note the Layby is on and is part of the A316. It is not part of Crispen Road:- • in addition to being the highway authority, is TfL the authority with the legal obligation for keeping the Location and Layby clean and/or clear of debris; • what inspection and safety procedures does TfL have for the Location and Layby and provide copies; • what kinds of inspection and safety reports does TfL have for the Location and Layby; • provide copies of such reports for the period July 2016 to June 2017; • if TfL is not responsible for keeping the Location and Layby clean and clear of debris, kindly confirm the representatives of and the authority responsible for keeping the Location and Layby clean and/or clear of debris during the three months up to on or about 15th October 2016; • how may such persons/organisations be contacted and what are the contact details; • if TfL does have the legal obligation, who were its servants and/or agents and/or contractors responsible for inspecting and keeping the Location and Layby clean and clear of debris during the three months up to on or about 15th October 2016; • how may such persons/organisations be contacted and what are the contact details; • did TfL or its servants or agents report the dangerous state of the Layby to the authority responsible for keeping it clean and clear of debris and please provide copies of relevant reports; • is TfL is responsible for the operation of buses on this route; • if not, kindly confirm who are the representatives of and the entity responsible for the operation of buses on this route; • how may such persons/organisations be contacted and what are the contact details; • if TfL is responsible for the operation of buses on this route, who were TfL’s servants and/or agents and/or contractors responsible for operating buses on the route in the three month period up to on or about 15th October 2016; • how may such persons/organisations be contacted and what are the contact details; • what action if any did TfL take to ensure the operators of buses on this route reported safety hazards [including gravel and oil pools] on or about 15th October 2016 at the Layby and please provide relevant documentary evidence; In relation to the threats to life posed by surface grit and debris to cyclists and motorcyclists at the Layby: • what safety measures has TfL implemented in general; • how were those measures implemented with respect to the Layby on 15th October 2016 and during the preceding three month period; • and in each case provide relevant documentation.

We answered

Thank you for your email received by us on 21 June 2017 asking for information about the maintenance of the A316 Feltham highway and the layby for the Crispen Road bus stop on the A316.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy. I can confirm that we hold some of the information you require.

You requested the following information:
the part of the A316 Feltham highway up to and including 100 metres east and 100 metres west [the “Location”] of the Crispen Road bus stop layby [the “Layby”].
Please note the Layby is on and is part of the A316. It is not part of Crispen Road:-

• in addition to being the highway authority, is TfL the authority with the legal obligation for keeping the Location and Layby clean and/or clear of debris;
Hounslow Council is the litter authority and therefore responsible for the sweeping and cleaning of this area, rather than TfL.

• what inspection and safety procedures does TfL have for the Location and Layby and provide copies;

• what kinds of inspection and safety reports does TfL have for the Location and Layby;

• provide copies of such reports for the period July 2016 to June 2017;

In relation to the threats to life posed by surface grit and debris to cyclists and motorcyclists at the Layby:

• what safety measures has TfL implemented in general;

• how were those measures implemented with respect to the Layby on 15th October 2016 and during the preceding three month period;
• and in each case provide relevant documentation.
TfL's London Highways Alliance Contract (LoHAC) contractor, Conway Aecom carry out safety inspections at this location every 28 days. The attached inspection record indicates that no relevant defects were identified. TfL has not made any report to Hounslow relating to the condition of the layby.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

• if TfL is not responsible for keeping the Location and Layby clean and clear of debris, kindly confirm the representatives of and the authority responsible for keeping the Location and Layby clean and/or clear of debris during the three months up to on or about 15th October 2016;

• how may such persons/organisations be contacted and what are the contact details;

As previously mentioned, the London Borough of Hounslow is the authority responsible for the sweeping and cleaning of this area. They can be contacted via the following links to their website:

As previously stated, TfL'S LoHAC contractor Conway Aecom carry out safety inspections at this location every 28 days. The attached inspection record indicates that no relevant defects were identified. TfL has not made any report to Hounslow relating to the condition of the layby.

• is TfL is responsible for the operation of buses on this route;
• if not, kindly confirm who are the representatives of and the entity responsible for the operation of buses on this route;

TfL operates a single bus route along this section of Country Way, route 290, which runs from Staines Bus Station to Twickenham Rugby Tavern. We are not aware of any other commuter service that operates along this section of highway, however, as this is categorised as an unrestricted road, any out of service bus/coach or equivalent vehicle would be able to use this road. For example, bus routes 111, 285, 490, H25, R70, and X26 operate on adjacent or nearby roads and may be directed down this route if, for instance they are on diversion.

We are not aware of any other commuter service operating along this section of highway.

• if TfL is responsible for the operation of buses on this route, who were TfL’s servants and/or agents and/or contractors responsible for operating buses on the route in the three month period up to on or about 15th October 2016;

Between July 2016 to October 2016, route 290 was operated by Abellio London from their Twickenham depot. The contract for this route tender was awarded in October 2016. Abellio’s contact details are below:

I can advise that we have not been made aware of any issues at this bus stop by the operator nor internally.
