Under the Freedom of Information ACT, can you please provide me with the number of Directors and Senior Managers (PB5 and 4) who have been given a 2 or 1 rating. Can you please provide this information by company TfL, Surface and LUL by Directorate for PB4 to Director for 2018/19 and 2019/20.

Thank you for your request received on 7 July 2020 asking for information about senior manager performance ratings.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.

TfL will at all times endeavour to create an environment that will support employees to achieve and maintain a high level of performance in their work. TfL’s performance review process is the primary tool for assessing the performance and supporting the development of employees. For those members of staff who receive a lower performance rating then a Performance Improvement Plan will be developed between them and their line manager. Feedback will regularly be given to employees promptly where any shortfalls in performance occur, and provide any necessary training, coaching, support and/or guidance.

Please find attached the requested information.

In accordance with our obligations under Data Protection legislation, information on positions where the individuals captured by your request is small enough that an individual’s score could be calculated has been withheld as required by section 40(2) of the FOI Act. Disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
