You asked

1. Legal papers on the TFL website state the organisation has applied for protest injunctions against Just Stop Oil and Insulate Britain (or people acting on their behalf, in association with them, or under their instruction, direction or name). Please can you provide the total spent on legal fees to obtain these protest injunctions since 2022, including applications to make the injunctions permanent, or to expand them? Please note this is not covered by the personal information exemption as I'm asking for the total spent by the company rather than individual fees for lawyers. 2. How many of the individuals named on TFL’s protest injunctions contested the granting of the injunctions (as in they appeared or were represented in the hearings granting the injunctions)? 3. How many individuals have breached the injunctions? I. How many individuals have received fines for breaching the injunctions? What is the total of these fines? II. How many individuals have received suspended sentences for breaching the injunctions? What are the shortest and longest sentences received? III. How many individuals have received prison sentences for breaching the injunctions? What are the shortest and longest sentences received? 4. How many of these individuals were made liable for some of TFL’s legal costs for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions? 5. What was the total sum these individuals owe TFL for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions? 6. How much has been recovered from them by TFL for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions?

Thank you for your request received on 1 May 2024 asking for information about injunctions.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm that we hold some of the information you require. You asked:

1.         Legal papers on the TFL website state the organisation has applied for protest injunctions against Just Stop Oil and Insulate Britain (or people acting on their behalf, in association with them, or under their instruction, direction or name). Please can you provide the total spent on legal fees to obtain these protest injunctions since 2022, including applications to make the injunctions permanent, or to expand them? Please note this is not covered by the personal information exemption as I'm asking for the total spent by the company rather than individual fees for lawyers.

External legal spend in the Insulate Britain case since April 2022 to date is £129,735.00 and for Just Stop Oil £123,575.

2.         How many of the individuals named on TFL’s protest injunctions contested the granting of the injunctions (as in they appeared or were represented in the hearings granting the injunctions)?

According to our records, 14 named defendants sent written submissions to the court raising various issues including proportionality and need for the injunctive relief sought by TfL. One of the named defendants claimed to represent 42 other named defendants and was allowed to make oral submissions at the hearing.

3.         How many individuals have breached the injunctions?
I.          How many individuals have received fines for breaching the injunctions? What is the total of these fines?

No individual has been prosecuted by TfL.

II.         How many individuals have received suspended sentences for breaching the injunctions? What are the shortest and longest sentences received?

No individual has been prosecuted by TfL.

III.        How many individuals have received prison sentences for breaching the injunctions? What are the shortest and longest sentences received?

No individual has been prosecuted by TfL.

4.         How many of these individuals were made liable for some of TFL’s legal costs for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions?

We do not hold this information as we are still in the course of assessing cost liabilities with the court.

5.         What was the total sum these individuals owe TFL for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions?
6.         How much has been recovered from them by TFL for (a) the granting of the injunctions (not contesting) (b) breaching the injunctions and (c) contesting the injunctions?

Costs orders were granted in both the Just Stop Oil and Insulate Britain injunctions. Those liable to pay costs have since the grant of the final injunctions made applications to the court seeking to sign an undertaking and be discharged from the costs liability. We are still awaiting judgment in response to those applications after which the costs position will be finalised.
