Thank you for your email received by us on 17 May 2017 asking for information about common law rights and privacy laws in relation to average speed cameras and the Congestion Charging scheme.

The powers under which TfL enforces traffic contraventions on our roads are conferred by Acts of Parliament. There is no requirement within any of the Acts for us to seek consent from drivers or vehicle owners prior to or during any enforcement action. We are entirely satisfied that all of our enforcement procedures are fully compliant with relevant legislation, including those clauses of the Magna Carta which remain on statute.
