Under the freedom of information act. On the government website it say that ULEZ are LAW Please state the LAW you are referring to? Please confirm the date this LAW was implemented and by whom? Please provide the difference between LAW and legislation as defined by black law dictionary or which ever documents the government uses to define the definition of LAW.

Thank you for your request received by Transport for London (TfL) on 12 April 2023 asking for information about the ULEZ.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy.  I can confirm we do hold the information you require. You asked:

On the government website it say that ULEZ are LAW

The Ultra Low Emission Zone (ULEZ) is a road user charging scheme under section 295 and Schedule 23 of the Greater London Authority Act 1999, as amended.  Road user charging schemes are established by the making of a scheme order by TfL, in its capacity as a charging authority under schedule 23, which must be subject to public consultation and must also be confirmed by the Mayor of London (with or without modification) before they can come into force.  Subsequent changes by “variation orders” follow a similar process. In both cases, TfL has regard to guidance which the Mayor has issued as to the exercise of its road user charging functions and in particular the establishment and modification of schemes.  A copy of Schedule 23 (as amended) can be found at: http://www.legislation.gov.uk/ukpga/1999/29/schedule/23

The original ULEZ and subsequent scheme amendments were made by TfL and confirmed by the relevant Mayors under the following orders pursuant to Schedule 23 of the Greater London Authority Act 1999:
 
  • Establishment of the original central London ULEZ from September 2020: the Greater London Low Emission Zone Charging (Variation and Transitional Provision) Order 2014 made by TfL on 22 October 2014, and confirmed by the then Mayor of London (B. Johnson) on 23 March 2015;
  • Amendment principally to bring forward the commencement of the Central London ULEZ to 17 April 2018: the Greater London Low Emission Zone Charging (Variation and Transitional Provisions) Order 2017 made by TfL on 30 March 2017 and confirmed by the Mayor of London (S. Khan) on 2 November 2017;
  • Amendment principally to expand the ULEZ to inner London from 25 October 2022: the Greater London Low Emission Zone Charging (Variation and Transitional Provisions) Order 2018 made by TfL on 21 May 2018 and confirmed by the Mayor of London (S. Khan) on 6 June 2018; and
  • Amendment principally to expand the ULEZ to outer London from 29 August 2023: the Greater London Low Emission Zone Charging (Variation and Transitional Provisions) Order 2022 made by TfL on 21 November 2022 and confirmed by the Mayor of London (S. Khan) on 24 November 2022.
