With reference to Schedule 13 of the Franchise Agreement with KeolisAmey Docklands Ltd, please could I have a copy of all Performance Notices, Enforcement Notices and Warning Notices issued to the current franchisee since the commencement of the franchise.

Thank you for your request received by Transport for London (TfL) on 9 April 2018 asking for information about Performance Notices, Enforcement Notices and Warning Notices issued to the current franchisee since the commencement of the franchise for the DLR. I apologise for the delay in replying.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.  You asked: With reference to Schedule 13 of the Franchise Agreement with KeolisAmey Docklands Ltd, please could I have a copy of all Performance Notices, Enforcement Notices and Warning Notices issued to the current franchisee since the commencement of the franchise.

The Franchise with KeolisAmey Docklands Ltd commenced on 7 December 2014.

o   Issued 16/4/2016

o   Issued 15/2/2018

o   Issued 29/3/2018

·        Asset Management Performance Notice issued 17/4/15

·        General Performance Notice issued 17/3/2015

No Enforcement Notices or Warning Notices have been issued since the commencement of the Franchise.

DLRL is entitled to issue a Performance Notice on the Franchisee in the circumstances set out in Schedule 13 of the Franchise Agreement which is published on the TfL Website.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.
