Hello Submitting an FOI, relating to Bosence Farm in Cornwall, where it is Transport for London policy to send employees if they have been found to breach the drug use conde of conduct. Thank you for your request received by us on 4 April 2023 asking for information about the drug treatment centre, Bosence Farm in Cornwall.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we do hold the information you require.

TfL are committed to supporting employees who come forward to the Drugs and Alcohol Assessment Treatment Service (DAATS) or to their line manager with an alcohol and/or drugs related problem. DAATS was established to provide assistance for employees who are experiencing problems with alcohol and/or drugs with the aim of returning them safely back to the workplace.

You asked:

•           The number of TfL employees that have been sent to Bosence Farm in Cornwall for drug rehabilitation centre for the most recent five year period for which you obtain full data, broken down by year

In accordance with the FOI Act we are not obliged to supply this information as it is subject to a statutory exemption to the right of access to information under section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the UK General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.

•           How much TfL spent each year on this programme, for the most recent five year period

We are not obliged to supply this information as it is subject to the statutory exemption to the right of access to information under section 40(2). In this instance the exemption has been applied as disclosure of this information, combined with other information already in the public domain, could create a ‘mosaic effect’ that would allow someone how many members of staff have been admitted to the programme which is being withheld (as detailed above).
