SECTION ONE: SCOPE OF PERFORMANCE MEASUREMENT CODE |
| 1 The purpose of this Performance Measurement Code is to monitor and measure the degree to which an Infraco is fulfilling its obligations under the applicable PPP Contract, particularly its obligations to provide acceptable Infrastructure Services to LUL as more particularly specified in Schedule 2.1 of the PPP Contracts ( Service Outputs ). |
| 2 This Performance Measurement Code sets out the method of attributing responsibility for certain events to Infraco or LUL. |

3 This Performance Measurement Code deals in particular, with the following areas in respect of Train Services and Station Services: (b) Availability; (c) Ambience; (d) Service Points; and (e) Data Records. |
| 4 Certain Line-specific ( and hence Infraco-specific ) measures and other data used in the processes and procedures by which LUL will monitor and measure the degree to which a particular Infraco is fulfilling its obligations under the applicable PPP Contract, are set out in Schedule 2.2 ( Line Specific Performance Measurements ) and 2.3 ( NACHs Tables ) of the PPP Contracts. |
| 5 The measurement of performance and allocation of responsibility as set out in this Performance Measurement Code impacts on the calculation of the performance related payments which an Infraco receives from LUL under the applicable PPP Contract. The payment mechanism for Infraco's performance is set out in Schedule 4.1 ( Performance Payment Mechanism ) |
| 6 This Performance Measurement Code includes the procedures for agreeing certain changes to the Performance Measurement Code. |
