1. TRAIN SERVICE

1.1 Capability

Journey Time Capability

1.1.1

Subject to paragraph 1.5.5, Infraco shall, in respect of each Line Grouping, maintain, renew and replace the Train Facilities such that the Journey Time Capability for such Line Grouping shall not be greater than the applicable Journey Time Capability set out in the table below:

1.2 Train Service Availability

Train Delivery

1.2.1 Subject to paragraph 1.2.9 below, Infraco shall, in respect of each JNP Line, ensure that Trains are delivered at the times and locations specified in the Working Timetables in accordance with the train preparation procedures set out in Appendix 2 ( Train Preparation Procedures ) and the Manual ( such delivery being known as Train Delivery ).

Train Return

1.2.2 Subject to paragraph 1.2.9 below, Infraco shall, in respect of each JNP Line, accept the return of Trains at the times and locations specified in the Working Timetables in accordance with the procedures set out in the Manual ( such return being known as Train Return ). Infraco acknowledges that for operational purposes, any particular Train may not be returned by LUL to the Depot Premises or Sidings specified in the Working Timetables, if any. LUL may, from time to time, to the extent reasonably necessary for the efficient running of the Underground Network, request Infraco to accept Trains at Depot Premises and Sidings other than at the times and locations specified in the Working Timetables provided that LUL shall use reasonable endeavours to ensure that it returns a sufficient number of Trains to the Depot Premises to enable Infraco properly to comply with its obligations under paragraph 1.2.1 above. In exercising such right, LUL shall endeavour to provide Infraco with as much notice as is practicable in the circumstances.

LUL will, as far as is reasonably practicable, provide Train operators to return Trains being taken out of service to the specified Depot Premises or Sidings, move Trains between Depot Premises and run test, de-icing and adhesion Trains on track sections where required to do so by Infraco.

Train Facilities to be Available

1.2.3 Infraco shall ensure that all Train Facilities are Available during the period from the time of Train Delivery to the time of Train Return as specified in the Working Timetables.

Train Staff Facilities at Depot Premises, Train Crew Depots, Train Maintenance Depots and Sidings to be Available

1.2.4 Infraco shall ensure that all relevant Train Staff Facilities including, for the avoidance of doubt, those set out in Appendix 4A ( Train Staff Facilities ) are Available to LUL Staff at Depot Premises, Train Maintenance Depots, Train Crew Depots and Sidings as is necessary to enable LUL Staff to access Depot Premises, Train Maintenance Depots, Train Crew Depots and Sidings for the purpose of Train Delivery and Train Return.

Train Service Facilities to be Available

1.2.5 Infraco shall ensure that all Train Facilities including those set out in Appendix 4B ( Train Service Facilities ) are Available at all such times as are necessary to enable the operation of Trains by LUL.

Line Control Room Assets and Facilities to be Available

1.2.6 Infraco shall be responsible for maintenance, ownership, software, infra-structure and upgrade thereof as set out in Schedule 4 of the Inter Infraco Assets and Facilities Agreement and Appendix 20 of this Schedule 2.1 to ensure all Line Control Room Facilities are Available at all such times as are necessary to enable the operation of Trains by LUL.

Permanent changes to Working Timetables

1.2.7 LUL may make permanent changes to the Working Timetables provided that:

(a) prior to making any such permanent changes, LUL has consulted with Infraco with respect to such proposed change;
(b) any such permanent change does not reduce the number of Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than five (5) minutes at the start of Engineering Hours and by more than five (5) minutes at the end of Engineering Hours on any individual Traction Current Section. For the avoidance of doubt, any such permanent change shall not reduce Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than ten (10) minutes from those applicable from the Transfer Date;
(c) any such permanent change does not require Infraco to make more Trains of each stock type Available, in any individual Peak Hour, than the number of Trains of each stock type declared Available for the Peak Hour timeband ( p=1 ) as set out in the Capability Model Data in Appendix 5 ( Capability Model Workbook ) of Schedule 2.2 of the PPP Contract ( N( j,p=1 ) ) as modified from time to time in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedure );
(d) any such permanent change does not require Infraco to make more Trains of each stock type Available, in any individual Non-Peak Hour, than ninety per cent. ( 90% ) of the number of Trains of each stock type declared Available for the Peak Hour timeband ( p=1 ) as set out in the Capability Model Data in Appendix 5 ( Capability Model Workbook ) of Schedule 2.2 of the PPP Contract ( N( j,p=1 ) ) as modified from time to time in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedure ) and notwithstanding the number of Trains declared Available for the Non-Peak Hour timeband ( p=2 ) as set out in the Capability Model Data, save that such limitation of ninety per cent. ( 90% ) shall not apply to the hours immediately before and after the Peak Hours ( i.e. 06:00-07:00, 10:00-11:00, 15:00-16,00 and 19:00-20:00 ) to allow for the ramp-up and ramp-down of Train numbers that occurs during the transition between Peak Hours and Non-Peak Hours;
(e) Notwithstanding paragraph 1.2.7(d), where the number of Trains of a stock type j declared Available for the Non-Peak Hour timeband, ( p=2 ) as set out in the Capability Model Data in Appendix 5 ( Capability Model Workbook ) of Schedule 2.2 of the PPP Contract ( N( j,p=2 ) ) as modified from time to time in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedure ), exceeds ninety per cent. ( 90% ) of the Peak Hour timeband declaration for the same stock type ( N( j,p=1 ), then any such permanent change does not require Infraco to make more Trains Available in any individual Non-Peak Hour than the Non-Peak Hour timeband declaration N( j,p=2 ) for that stock type, save that such limitation shall not apply to the hours immediately before and after the Peak Hours ( i.e. 06:00-07:00, 10:00-11:00, 15:00-16,00 and 19:00-20:00 ) to allow for the ramp-up and ramp-down of Train numbers that occurs during the transition between Peak Hours and Non-Peak Hours; and
(f) LUL has notified Infraco not later than three (3) months prior to the date of implementation of such permanent change.

Temporary changes to Working Timetables

1.2.8 LUL may make temporary changes to Working Timetables for dealing with special events, bank holidays or other factors provided that: (a) prior to making any such temporary changes, LUL has consulted with Infraco with respect to such proposed changes;

(b) subject to paragraphs 1.2.8(c), 1.2.8(g) and 1.2.8(i) below, any such temporary change does not reduce the number of Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than fifteen (15) minutes at the start of the period of Engineering Hours and by more than ten (10) minutes at the end of the period of Engineering Hours in respect of any Traction Current Section. For the avoidance of doubt, any such temporary change shall not reduce the Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than twenty-five (25) minutes;

(c) on Boxing Day and New Years Eve, subject to paragraph 1.2.8(g) below, any such temporary change does not reduce the number of Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than ninety (90) minutes at the start of the period of Engineering Hours and by more than ninety (90) minutes at the end of the period of Engineering Hours in respect of any Traction Current Section;

(d) any such temporary change does not conflict with access to any part of the Underground Network previously granted to any party under the Access Code unless such party gives its prior consent;

(e) LUL has given notification of such temporary change to Infraco no later than:
(i) six (6) weeks prior to the date of implementation of such temporary change when such change shall require the alteration of the stabling of more than five (5) Trains on each Line; or

(ii) ten (10) calendar days prior to the implementation of such temporary change when such change shall require the alteration of the stabling of five (5) Trains or less on each Line;

(f) in the notification to Infraco pursuant to paragraph 1.2.8(e) above, LUL states the number of Trains required during Non-Peak Hours;

(g) for any temporary timetable change required by Infraco, LUL shall give notification to Infraco in accordance with paragraph 1.2.8(e) above providing that Infraco has given the correct notice under the Access Code unless such notice is less than six (6) weeks in which case LUL shall make reasonable endeavours to provide a suitable timetable. In respect of any temporary timetable change required by Infraco, the reduction in Engineering Hours may be greater than that required under paragraph 1.2.8(b) above;

(h) for the Traction Current Sections between Preston Road and Willesden Green and for no more than twenty (20) periods of Engineering Hours in any Contract Year, any such temporary change does not reduce the number of Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than fifty (50) minutes at the start of the period of Engineering Hours and by more than ten (10) minutes at the end of the period of Engineering Hours in respect of any Traction Current Section. For the avoidance of doubt any such temporary change shall not reduce the Engineering Hours calculated in accordance with the Modified Original Working Timetable by more than sixty (60) minutes; and

(i) notwithstanding paragraph 1.2.8(d), where, as a consequence of a royal funeral or such similar circumstances, LUL requests a temporary change to the Working Timetable but is unable to give Infraco notice of such temporary change in accordance with paragraph 1.2.8(e), Infraco shall comply with LUL's request provided that LUL shall pay Infraco a reasonable level of compensation for the costs incurred by Infraco as a result of LUL being unable to give Infraco notice of a temporary change, such level to be agreed between LUL and Infraco.
If, following any meeting pursuant to this paragraph 1.2.8(i) the parties are unable to agree the level of compensation, either party may refer the issue for resolution in accordance with the dispute procedure set out in the Dispute Resolution Agreement.

All Night Running

1.2.9 For not more than three (3) periods of Engineering Hours per JNP Line in any Contract Year, LUL may, following consultation with Infraco, implement All Night Running of Train Services provided that LUL has notified Infraco within a reasonable period of time and in any event not later than five (5) Business Days prior to the date of implementation of such requirement. LUL shall pay Infraco a reasonable level of compensation for the costs incurred by Infraco as a result of the implementation of All Night Running, such level to be agreed between LUL and Infraco.

If, following any meeting pursuant to this paragraph 1.2.9 the parties are unable to agree the level of compensation, either party may refer the issue for resolution in accordance with the dispute procedure set out in the Dispute Resolution Agreement.

1.3 Other Train Facilities to be Available

Infraco shall ensure that those Train Facilities as required by LUL to operate the Service set out in sub-paragraphs (a) to (h) below and set out in Appendix 4 ( Train Staff and Train Service Facilities ) are Available during the period from the time of Train Delivery to the time of Train Return and are Available to LUL Staff at all other times as required by LUL to operate the Train Service subject to any rights of access having been granted in accordance with the Access Code:

(a) Trains;

(b) all civil engineering and other structures necessary or expedient to enable LUL Staff to operate the Train Service;

(c) all forecourts, concourses, platforms, overbridges and other parts of the Premises necessary or expedient to enable applicable LUL Staff access to and egress from the Trains, and the use of the Train Facilities listed in paragraphs (d) to (f) below;

(d) emergency equipment assets ( on Trains, by the side of tracks and at Stations ) for the exclusive use for the Trains;

(e) fire detection, fire alarm, fire fighting equipment and other safety equipment reasonably necessary to comply with the safety obligations of both Infraco and LUL regarding the safe operation of the Trains;

(f) Staff Accommodation;

(g) Trackside Structures; and

(h) machinery, equipment, washroom consumables and fixtures and fittings necessary for the proper use of the Train Facilities set out in paragraphs (a) to (g) above. Provided That:
(i) Subject to paragraphs (ii) and ( iii ) below, Infraco shall not be responsible for the provision, installation or maintenance of either LUL Furniture and Office Equipment or LUL Staff Portable Equipment;

(ii) Notwithstanding paragraph (i) above, LUL may request Infraco to carry out the installation of any items of LUL Furniture and Office Equipment or LUL Staff Portable Equipment by means of a Minor Works Request in accordance with the provisions of paragraph 6 of this Schedule 2.1; and

( iii ) Infraco shall in any event be responsible at its own cost for the carrying out of all necessary testing and inspection, including portable appliance testing, leak testing of LUL Staff Portable Equipment and of any LUL Furniture and Office Equipment which consists of Portable Equipment in accordance with applicable statutory requirements and Laws and Standard subject to LUL having notified Infraco in writing of the existence and location of any such Portable Equipment to be tested and allowing the necessary access thereto.

1.4 Train Ambience

Infraco shall meet the following requirements in relation to all Train Facilities during the period from the time of Train Delivery to the time of Train Return:

(a) all surfaces inside the Train carriage including window frames, walls, ceilings, window ledges, soffits, floors, seats, window panels and other internal panelling and glazing shall be Clean and free from litter, Graffiti and Unauthorised Stickers. Any designed patterns, colours and markings ( including the carriage number and the Roundel ) shall be intact and clearly visible;

(b) Train seats shall be Clean, undamaged and free from litter, tears, burns, scorch marks and signs of wear;

(c) all seat arm rests, hand rails and hangers shall be Clean, intact and undamaged;

(d) all visible surfaces outside the Train carriage including window ledges, window frames, roofs, doors, window panels and the front and rear of each Train carriage shall be Clean and free from Graffiti and Unauthorised Stickers. Any designed patterns, colours and markings ( including the carriage number and the Roundel ) shall be intact and clearly visible;

(e) all Train windows shall be Clean and free from Graffiti and Unauthorised Stickers ( both internally and externally );

(f) all live and pre-recorded announcements made by any Public Address System shall be static free and clearly audible;

(g) the general interior and exterior decor of each Train shall be in good condition and undamaged. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(h) (i) Trackside Structures shall be Clean and free from Offensive Graffiti and Stickers; and

(ii) Trackside Structures shall be cleaned of Graffiti and Unauthorised Stickers when works of refurbishment, renewal or repair are being carried out to them. While carrying out such works, Infraco shall use its best endeavours to remove Graffiti and Unauthorised Stickers in the immediate vicinity.


(i) Train Facilities, machinery, equipment, fixtures or fittings other than trackside cabling which are rendered redundant by renewal or replacement or which are no longer required by LUL and/or Infraco shall be removed and Infraco, acting reasonably and in accordance with Good Industry Practice, shall carry out repairs to or reinstatement of the affected decor using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(j) all redundant cabling which is in public areas, which can be safely removed and is no longer necessary for the performance of the Services or any other purpose by LUL or any third party or PFI Contractor shall be identified, labelled and removed. Redundant cabling which is not to be removed shall be cut back into ceiling voids, underneath floor panels, into troughs or conduit or to the nearest distribution point. Cable ends thus created shall be clearly labelled and secured in accordance with Good Industry Practice and all relevant Standards and principles;

(k) the noise generated by the motion of a train that is audible to Customers in each carriage shall be at, or below, a level which permits announcements made over a Public Address System to be clearly audible by Customers inside each carriage;

(l) the ride quality for Customers on Trains shall be such that there shall be no undue lateral or vertical motion or jolts and no undue acceleration or deceleration in Train speed;

(m) luminares and other lights inside Train carriages shall be undamaged, free from dust and dirt and functioning according to their design capability;

(n) the temperature in the area of the Train carriage used by Customers shall be capable of being controlled so as to minimise divergences from the default temperature at which the thermostatic control in the Train is set; and

(o) Staff Accommodation shall be Clean, undamaged and free from litter, Graffiti and Unauthorised Stickers. General decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition. Any designed patterns and colours shall be clearly visible and complete. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area. Such repairs shall be undertaken where redundant fixtures or fittings are removed or replaced.

1.4.1 From the Transfer Date until twelve (12) months thereafter, scores for the Train Ambience requirements in sub-paragraphs (k), (l), (m) and (n) of paragraph 1.4 above, shall be measured as set out in paragraph 2 of Part A of Schedule 7 of the Performance Measurement Code ( Audit Criteria and Procedures ).
1.4A Minimum train ambience

Infraco shall ensure that the Train Ambience scores for each Line are not less than the minimum Train Ambience scores set out in Appendix 6A ( Minimum Train Ambience Scores for each Line ).

1.5 Capability enhancements

1.5.1 Infraco shall, in respect of each Line Grouping, achieve the Specified Line Upgrades by Delivering into Service such new or enhanced Train Facilities as are necessary to meet the Journey Time Capability target scores set out in Appendix 5A ( Specified Line Upgrades ) by no later than the Latest Implementation Date, as specified in Appendix 5A and without exceeding the Maximum Wheel Start-Wheel Stop Times set out in Appendix 5B ( Maximum Wheel Start-Wheel Stop Times ).
1.5.2 Infraco shall not exceed the Maximum Wheel Start-Wheel Stop Times set out in Appendix 5B ( Maximum Wheel Start-Wheel Stop Times ).
1.5.3 When implementing the Specified Line Upgrade of the Northern Line, as more particularly described in Appendix 5A hereto, Infraco shall first complete its works to achieve such upgrade on the Line Sections between Morden and Kennington and shall provide full Automatic Train Operation capability on Trains running on the Northern Line prior to the Latest Implementation Date.
1.5.4 When implementing the Specified Line Upgrade of the Jubilee Line, as more particularly described in Appendix 5A hereto, Infraco shall use its reasonable endeavours to achieve a Journey Time Capability score of 16.79 by no later than 24th October 2007 and shall first complete its works to achieve such upgrade on the Line Sections between Green Park and Stratford.
1.5.5 With effect from Delivery into Service of any new or enhanced Train Facilities which achieves the Journey Time Capability target scores referred to in paragraph 1.5.1 above, paragraph 1.1.1 shall be amended to reflect the Journey Time Capability target scores to be achieved by Infraco as set out in Table 1 of Appendix 3 of Schedule 4.1 of the PPP Contract. For the avoidance of doubt, the benchmark set out in Appendix 2 of Schedule 4.1 of the PPP Contract shall not be affected, notwithstanding that the Specified Line Upgrade of the Jubilee Line to be implemented by 31 st December 2009 ( as set out in Table 1 of Appendix 3 of Schedule 4.1 ) may be delivered at the same time the Benchmarks are re-set at 7 th January 2012 in accordance with Appendix 2 of Schedule 4.1.
1.6 Enhancements to Train Facilities

Infraco shall Deliver into Service the enhancements in relation to Train Facilities specified in Appendix 7 ( Enhancements to Train Facilities ).
1.7 Refurbishment of Trains and Staff Accommodation

Infraco shall deliver the Train Refurbishments and Staff Accommodation refurbishments specified in Appendix 8 ( Refurbishment of Trains and Staff Accommodation ).

1.8 Transition Projects

1.8.1 Infraco shall implement the Transition Projects in relation to Train Facilities specified in Appendix 18 ( Transition Projects ) Provided That Infraco shall not be in breach of its obligation to complete a Transition Project by the date specified in column 5 of the table in Appendix 18 where a third party contractor under an existing contract is entitled to an extension of time or similar relief beyond that date to complete the Transition Project in accordance with its contract unless that entitlement arose as a result of the Infraco failing to act in accordance with Good Industry Practice. Immediately following completion of a Transition Project in accordance with the terms of any agreement entered into relating to such Transition Project, Infraco shall be responsible thereafter for the maintenance and renewal of any new Facility or other Asset Delivered into Service as a consequence of the Transition Project and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect to any comparable Assets.

1.9 Introduction of new and enhanced Train Facilities

1.9.1 If at any time Infraco intends to Deliver into Service any: (a) enhancements to Train Facilities under the provisions of paragraph 1.5 or 1.6 above; or

(b) new Train Facilities ( which may or may not replace any existing Train Facilities ), whether in accordance with paragraph 1.5 or otherwise,
Infraco shall comply with Appendix 9A ( Train Conditions ) and Appendix 9C ( Conditions Procedure ).
1.9.2 At any time, Infraco may request LUL formally to agree in writing that the enhancements referred to in paragraphs 1.5.1 and 1.6 have been Delivered into Service.
1.9.3 The Delivery into Service of any new or enhanced Train Facility shall not adversely affect in any way the functioning of facilities and equipment in any Line Control Room or other control room relating to the National Railway Network, the Underground Network or the British Transport Police. In respect of any such Line Control Room or other control room the new or enhanced Train Facility shall have, as a minimum, the same level of functionality as was present in the Train Facility prior to the replacement or enhancement being carried out. If the new or enhanced Train Facility is delivered with a greater level of functionality then that greater level of functionality shall apply also to the Line Control Room or other control room by the relevant Latest Completion Date.
1.9.4 Immediately following completion of an input specified project, as detailed in Appendices 7, 8 and 14 to 18, Infraco shall be responsible thereafter for the maintenance and renewal of any Facility or other Asset Delivered into Service as a consequence of the Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to this Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect to any comparable Asset.

1.10 Stock training requirements

Training Rolling Stock

1.10.1A Infraco shall, having been given reasonable notice by LUL, make Rolling Stock available to LUL Staff for the purpose of training. These Trains shall be in addition to the Working Timetable provided that, in doing so, the total number of Trains available to LUL for both training and the Working Timetable does not require Infraco to make more Trains of any stock available than:

(a) the number of peak Trains NJ( j,p=1 ) specified in the Journey Time Capability Model as set out in the Capability Model Data in Appendix 5 ( Capability Model Workbook ) of Schedule 2.2 of the PPP contract or the number of Trains declared by Infraco or in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedure ) during the peak period; or
(b) 90% of the number of peak Trains NJ( j,p=1 ) specified in the Journey Time Capability Model as set out in the Capability Model Data in Appendix 5 ( Capability Model Workbook ) of Schedule 2.2 of the PPP contract or the number of Trains declared by Infraco in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedure ) during all times other than the peak period.
1.10.1B In the event that Infraco are in breach of their obligations described in paragraph 1.10.1A and LUL use Trains made available by Infraco for the Working Timetable for the purpose of training, then the Lost Customer Hours arising from the resulting Service Disruption will be attributable to Infraco.

Train cab simulators

1.10.2 Infraco shall, for training purposes: (a) make Train cab simulators Available to LUL Staff as set out in Appendix 10 ( Training Simulators ); and

(b) make a Train cab simulator Available to LUL Staff in respect of the introduction of any new types of Rolling Stock as specified in Schedule 5.5 of the PPP Contracts ( Training ).
1.10.3 Infraco shall maintain all Train cab simulators as set out in paragraph 1.10.2 above and upgrade to reflect any modifications that may occur to the relevant Rolling Stock as set out in Schedule 5.5 of the PPP Contracts ( Training ).
1.11 Train maintenance log

Infraco shall keep a record of all maintenance, refurbishment and other modification work carried out on Trains, such records to be retained for at least 10 years.

1.12 On-Train Customer Information

1.12.1 Infraco shall: (a) procure, install, maintain, remove and replace ( as required ) all signs and notices displayed inside Trains as LUL may reasonably require from time to time but excluding advertising and other Customer information notices which are produced by LUL or TfL;

(b) procure, install and maintain all In-car Line Diagrams and Central London Journey Planners displayed inside Trains; and

(c) ensure that all Customer information on Trains conveyed through In-car Line Diagrams, Central London Journey Planners, Automated Voice Announcers and Visual Electronic Information Display Panels ( other than information given by free-text messages ) is accurate and consistent with information reasonably provided by LUL from time to time.
1.12.2 Requests for changes to signs and notices displayed inside Trains and In-car Line Diagrams and or Central London Journey Planners made in accordance with the provisions of paragraph 1.12.1 above shall be put in writing and sent by the LUL Contract Manager to the Infraco Contract Manager. Infraco shall implement the requested changes within a fifteen (15) day period, which shall be specified by LUL when making the request. When defining the start and finish dates of the fifteen (15) day implementation period LUL shall ensure that Infraco is given a notice period of not less than fifteen (15) Business Days to enable it to design and procure the necessary changes to Customer information and to plan the implementation of such changes, such notice period to commence on the date upon which the request for changes is sent by the LUL Contract Manager to the Infraco Contract Manager.
1.12.3 Requests for changes to the Customer information provided by Automated Voice Announcers and Visual Electronic Information Display Panels in accordance with the provisions of paragraph 1.12.1 above shall be put in writing and sent by the LUL Contract Manager to the Infraco Contract Manager. LUL, acting reasonably and following discussion with Infraco, shall set a completion date for the works. Infraco shall complete the works by that date.
1.12.4 Notwithstanding the provisions of paragraphs 1.12.2 and 1.12.3 above, the Infraco Contract Manager may, acting reasonably, request in writing an extension to any of the time periods specified therein, stating the reasons for making the request, and the consent of the LUL Contract Manager to the request for such an extension shall not be unreasonably withheld.
1.12.5 Infraco shall implement all changes to on-Train customer information expeditiously, with all due care and skill and in accordance with Good Industry Practice.

1.13 Train Service Management Information Systems

1.13.1 The percentage of Availability of Train Service Management Information Systems will be expressed as the hours that such systems are Available for data capture and retrieval per Payment Period in relation to the number of service hours per Payment Period.
1.13.2 Infraco shall ensure that from the Transfer Date until twelve (12) months thereafter, the Northern Line Train Service Management Information System ( NORMIS ) is Available eighty per cent. ( 80% ) within any Payment Period.
1.13.3 Infraco shall ensure that from the period commencing twelve (12) months after the Transfer Date, the Northern Line Train Service Management Information System ( NORMIS ) is Available ninety eight per cent. ( 98% ) within any Payment Period.
1.13.4 LUL may, at any time and within a time frame to be agreed between the parties, require Infraco to provide a Train Service Management Information System for the Jubilee Line, in accordance with the provisions of clause 11K of the Service Contract.
1.13.5 If Infraco fails to meet its obligations as set out in paragraphs 1.13.2 or 1.13.3 above, the provisions of Schedule 8 of the Performance Measurement Code ( Service Points ) will apply.

2. STATION SERVICE

2.1 Station Service Availability

Station Facilities to be Available

2.1.1 Infraco shall ensure that: (a) during the Station Opening Hours;

(b) during the relevant preparation time periods set out in Appendix 11B ( Preparation Time Periods ) ( such period to precede, whether immediately or otherwise, the period of Station Opening Hours );

(c) during the fifteen (15) minute period immediately following the end of the period of Station Opening Hours; and

(d) at all other times, in each case to the extent necessary, in order to enable LUL to carry out its duties as Infrastructure Controller;
the Station Facilities set out in: (x) columns 2-9 of Table 1 in respect of each Line in Appendix 11C ( Service Critical Station Facilities ) shall be Available at each Station specified in that Appendix;

(y) columns 10-12 of Table 1 in respect of each Line in Appendix 11C ( Service Critical Station Facilities ) shall be Available at each platform serving the Line to which the table relates at each Station specified in that Appendix; and

(z) the tables in Appendix 11D ( Service Critical Station Facilities at Non-JNP Stations ) shall be Available at each platform serving the Line to which the table relates at each Non-JNP Station specified in that Appendix;
and all other Station Facilities including Station structures, Ticket Halls and Routeways, and those Station Facilities identified in: (i) the Station Layout Plans and the Station Fire Plans specified in Appendix 12 ( Station Plans );
(ii) the Property Schedules and Plans; and

( iii ) the Manual
( or approved replacements as introduced from time to time ) shall be Available at each Station.

Platforms, Lifts, escalators and Customer conveyors to be Available

2.1.2 Infraco shall ensure that: (a) during the Station Opening Hours;

(b) during the relevant preparation time periods set out in Appendix 11B ( Preparation Time Periods ) ( such period to precede, whether immediately or otherwise, the period of Station Opening Hours );

(c) during the fifteen (15) minute period immediately following the end of the period of Station Opening Hours; and

(d) at all other times, in each case to the extent necessary, in order to enable LUL to carry out its duties as Infrastructure Controller;
all platforms, Lifts, escalators and Customer conveyors at each Station identified in the Station Layout Plans and the Station Fire Plans specified in Appendix 12 ( Station Plans ) are Available for use by Customers.
2.1.3 LUL shall allow contractors to continue undertaking their duties at the Station up until fifteen (15) minutes before Station Opening Hours, where the relevant preparation time period set out in Appendix 11B ( Preparation Time Period ) of this Schedule 2.1 is greater than twenty (20) minutes and it is reasonably practicable, in safety and operational terms, to do so.

This clause does not imply that access is available at any Station other than that agreed under the Access Code.
2.2 Other Station Facilities to be Available
Infraco shall ensure that, in relation to each Station, or, where Appendix 13C ( Station Facilities at non-JNP Stations ) applies, each Non-JNP Station, those Station Facilities set out in sub-paragraphs (a) to (o) below and set out in Appendix 13 ( Station Facilities ) are Available during the applicable Station Opening Hours and are Available for LUL Staff at all other times as required by LUL to operate the Station Service subject to any rights of access having been granted in accordance with the Access Code: (a) all the Station Facilities set out or identified in any of the following documents even though such Station Facilities may not be set out in all documents ( or their approved replacements from time to time ):
(i) the Emergency Procedures Plan;

(ii) the Station Reference File;

( iii ) the Station Fire Plans;

(iv) the Station Layout Plans;

(v) the Property Schedules and Plans; and

(vi) the Manual;

(b) all Assets and systems ( including all forecourts, concourses, platforms and overbridges ) necessary or expedient to enable access to and egress from the Station and access to, egress from, and the use of, the Station Facilities listed in sub-paragraphs (c) to (o) below;

(c) first-aid equipment reasonably necessary to comply with the safety obligations of both Infraco and LUL relating to the Station;

(d) emergency equipment for all users of the Station;

(e) public toilets ( where they are provided );

(f) emergency telephones and telephone exchanges ( except where such telephones are linked to the Auto Telephone Network );

(g) waiting rooms;

(h) a reasonable number of Non-Electronic Whiteboards to provide information to Customers where such information cannot be efficiently communicated electronically, with a storage facility for such Non-Electronic Whiteboards at the Station in an area to which the public do not have access;

(i) directional signing to aid Customer movement into, within and out of the Station and car park and to indicate emergency exits with reasonable prominence;

(j) public clocks and Staff clocks ( whether analogue or digital ) located in the Ticket Hall, on the concourse and on the platforms which shall be operational and displaying the correct time;

(k) one portable barrier ( to be used to cordon off an area or to separate the flow of Customers ) in each area of the Station, including the Ticket Hall, Routeways and each pair of platforms, with a storage facility for such barriers at the Station in an area to which the public do not have access;

(l) Staff Accommodation;

(m) Customer Facing External Surfaces;

(n) any coin or cash handling equipment, coin scales and safes in the Station ( excluding any equipment which is the responsibility of the Prestige Contractor ); and

(o) machinery, equipment, washroom consumables and fixture and fittings necessary for the proper use of the Station Facilities set out in sub-paragraphs (a) to (n) above. Provided That:
(i) Subject to sub-paragraphs (ii) and ( iii ) below, Infraco shall not be responsible for the provision installation or maintenance of either LUL Furniture and Office Equipment or LUL Staff Portable Equipment.

(ii) Notwithstanding sub-paragraph (i) above, LUL may request Infraco to carry our the installation of any items of LUL Furniture and Office Equipment or LUL Staff Portable Equipment by means of a Minor Works Request in accordance with the provisions of paragraph 6 of this Schedule 2.1.

( iii ) Infraco shall in any event be responsible at its own cost for the carrying out of all necessary testing and inspection including portable appliance testing and leak testing of LUL Staff Portable Equipment and of any LUL Furniture and Office Equipment which consists of Portable Equipment in accordance with applicable statutory requirements and Laws and Standards subject to LUL having notified Infraco in writing of the existence and location of any such Portable Equipment to be tested and allowing the necessary access thereto.
2.2A Infraco shall make Available white and yellow platform/train interface lines ( in accordance with LUL Standards ) on platforms at Railtrack stations at which LUL Trains stop. In the event that Infraco has requested and Railtrack has denied Infraco access to such platforms, such obligation shall be contingent upon Infraco requesting LUL to procure and LUL procuring such access.
2.2B Infraco shall, on or before the first anniversary of the Transfer Date, assume responsibility for the provision, maintenance and upgrade of the Help Points on all Jubilee Line Extension Stations, which services are currently provided by LUL under the Corporate Service Agreement.

2.3 Station Ambience
Infraco shall meet the following Ambience requirements in relation to Station Facilities at every Station during the applicable Station Opening Hours:

Platforms

2.3.1 In relation to every platform at each Station: (a) platform walls, floors, ceilings, glazing, surfaces and Platform Edge Doors shall be Clean and free from litter, Graffiti and Unauthorised Stickers. Any designed patterns and colours shall be clearly visible;

(b) track-side walls shall be Clean and free from Graffiti and Unauthorised Stickers. Any designed patterns and colours shall be clearly visible;

(c) general platform decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition and undamaged. Any designed patterns and colours shall be clearly visible. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(d) trackbeds shall be free from litter;

(e) platform seats shall be Clean, undamaged and free from litter, burns, scorch marks, signs of wear and Graffiti;

(f) waiting rooms shall be open, Clean, free from unpleasant smells, with decor in good condition and free from litter, Graffiti and Unauthorised Stickers. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(g) Enclosed Waiting Areas shall be open, Clean, free from unpleasant smells and free from litter, Graffiti and Unauthorised Stickers. No panels shall be missing or damaged in any way;

(h) poster frames ( and transparent front panels ) shall be Clean and free from Graffiti and Unauthorised Stickers;

(i) Customer Facing External Surfaces shall be Clean and free from Graffiti and Unauthorised Stickers; and

(j) Station Facilities, machinery, equipment, fixtures or fittings which are rendered redundant by renewal or replacement or which are no longer required by LUL and/or Infraco shall be removed and Infraco, acting reasonably and in accordance with Good Industry Practice, shall carry out repairs to or reinstatement of the affected decor using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area.

Routeways

2.3.2 In relation to every Routeway at each Station: (a) Routeway walls, floors, ceilings, glazing, and surfaces shall be Clean and free from litter, Graffiti and Unauthorised Stickers. Any designed patterns and colours shall be clearly visible;

(b) general Routeway decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition and undamaged. Any designed patterns and colours shall be clearly visible. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(c) lifts, escalators and Customer conveyors shall be Clean and free from litter, Graffiti and Unauthorised Stickers;

(d) mirrors shall be Clean, undamaged and free from Graffiti and Unauthorised Stickers;

(e) poster frames ( and transparent front panels ) shall be Clean and free from Graffiti and Unauthorised Stickers; and

(f) Station Facilities, machinery, equipment, fixtures or fittings which are rendered redundant by renewal or replacement or which are no longer required by LUL and/or Infraco shall be removed and Infraco, acting reasonably and in accordance with Good Industry Practice, shall carry out repairs to or reinstatement of the affected decor using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area.

Ticket Halls

2.3.3 In relation to every Ticket Hall at each Station: (a) Ticket Hall walls, floors, ceilings, glazing and surfaces shall be Clean and free from litter, Graffiti and Unauthorised Stickers. Any designed patterns and colours shall be clearly visible;

(b) general Ticket Hall decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition and undamaged. Any designed patterns and colours shall be clearly visible. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(c) general Station Entrance decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition and undamaged. Any designed patterns and colours shall be clearly visible. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area;

(d) Ticket Offices shall be undamaged, Clean and free from litter, Graffiti and Unauthorised Stickers;

(e) poster frames ( and transparent front panels ) shall be Clean and free from Graffiti and Unauthorised Stickers;

(f) subway walls, floors, ceilings, windows and surfaces shall be Clean and free from litter, Graffiti and Unauthorised Stickers. Any designed patterns and colours shall be clearly visible;

(g) subway surfaces shall be free from litter;

(h) general subway decor ( including paint, plaster, tiling, glazing and brickwork, vitreous enamel and other panelling ) shall be in good condition and undamaged. Any designed patterns and colours shall be clearly visible. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area; and

(i) Station Facilities, machinery, equipment, fixtures or fittings which are rendered redundant by renewal or replacement or which are no longer required by LUL and/or Infraco shall be removed and Infraco, acting reasonably and in accordance with Good Industry Practice, shall carry out repairs to or reinstatement of the affected decor using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area.

Other Station Facilities

2.3.4 In relation to all other Station Facilities: (a) toilets shall be Clean, undamaged, fully-functioning, well lit, and free from litter, Graffiti and Unauthorised Stickers. General decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition. Any designed patterns and colours shall be clearly visible and complete. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area. Such repairs shall be undertaken where redundant fixtures or fittings are removed or replaced;

(b) all wires and cables shall be hidden from public view or, if required to be visible in order to comply with Standards, shall be Clean, neat and properly retained;

(c) leaflet racks shall be Clean and free from Graffiti and Unauthorised Stickers;

(d) builders' hoardings shall be Clean, sturdy and free from Graffiti and Unauthorised Stickers;

(e) Electronic Whiteboards shall be Clean and fully operational, so that the information they display is clearly readable;

(f) direction and information signs shall be Clean, undamaged and free from Graffiti and Unauthorised Stickers, with all lettering and symbols readable;

(g) glass and other canopies in subways and at Station Entrances shall be Clean, undamaged and free from litter, Graffiti and Unauthorised Stickers;

(h) Staff Accommodation shall be Clean, undamaged and free from litter, Graffiti and Unauthorised Stickers. General decor ( including paint, plaster, tiling, brickwork, glazing, vitreous enamel and other panelling ) shall be in good condition. Any designed patterns and colours shall be clearly visible and complete. All repairs that are carried out to decor shall be undertaken in accordance with Good Industry Practice using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area. Such repairs shall be undertaken where redundant fixtures or fittings are removed or replaced;

(i) all forecourts, concourses and overbridges shall be Clean, undamaged and free from litter, Graffiti and Unauthorised Stickers;

(j) Customer Facing Exterior Surfaces shall be Clean and free from Graffiti and Unauthorised Stickers; and

(k) Station Facilities, machinery, equipment, fixtures or fittings which are rendered redundant by renewal or replacement or which are no longer required by LUL and/or Infraco shall be removed and Infraco, acting reasonably and in accordance with Good Industry Practice, shall carry out repairs to or reinstatement of the affected decor using materials which are of the type, colour and tonal value as similar as reasonably practicable to those which are in the immediate surrounding area.
2.4 Minimum Station Ambience
Infraco shall ensure that the Station Ambience scores for each Station are not less than the minimum Station Ambience scores set out in Appendix 6B ( Minimum Station Ambience Scores for each Station ).
2.5 Enhancements to Station Facilities
Infraco shall Deliver into Service the enhancements to Station Facilities specified in Appendix 14 ( Enhancements to Station Facilities ).
2.6 Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment Infraco shall Deliver into Service, in relation to each Station, the Station Modernisations, Enhanced Station Refurbishments and Station Refurbishments, specified in Appendix 15 ( Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment ).
2.6A Tactile Installation Works and Platform Resurfacing Works

Infraco shall Deliver into Service the Tactile Installation Works at those Stations listed in paragraph 4 of Appendix 15A and the Platform Resurfacing Works at those Stations listed in paragraph 5 of Appendix 15A.

2.7 Implementation of certain projects

Station Accessibility Projects

2.7.1 Infraco shall implement the Station Accessibility Projects specified in Appendix 16 ( Station Accessibility Projects ).

Additional Projects

2.7.2 Infraco shall implement the Additional Projects specified in Appendix 17 ( Additional Projects ).

Transition Projects

2.7.3 Infraco shall implement the Transition Projects in relation to Station Facilities specified in Appendix 18 ( Transition Projects ) provided that Infraco shall not be in breach of its obligations to complete a Transition Project by the date specified in column 5 of the table in Appendix 18 where a third party contractor under an existing contract is entitled to an extension of time or similar relief beyond that date to complete the Transition Project in accordance with its contract unless that entitlement arose as a result of the Infraco failing to act in accordance with Good Industry Practice. Immediately following completion of a Transition Project in accordance with the terms of any agreement entered into relating to such Transition Project, Infraco shall be responsible thereafter for the maintenance and renewal of any new Facility or other Asset Delivered into Service as a consequence of the Transition Project and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to this Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect to any comparable Assets.
2.7.4 The provision of clause 13 ( Contract Management ) of the Service Contract shall apply in respect of all projects in Appendices 7, 8 and 14 to 18 as if references in that clause were references to such projects.

2.8 Introduction of new and enhanced Station Facilities

2.8.1 If at any time Infraco intends to Deliver into Service any: (a) enhancements to Station Facilities in accordance with paragraph 2.5 above; or

(b) new Station Facilities ( which may or may not replace any existing Station Facilities ),
Infraco shall comply with Appendix 9B ( Station Conditions ) and Appendix 9C ( Conditions Procedure ).
2.8.2 At any time Infraco may request LUL formally to agree that the enhancements referred to in paragraph 2.5 have been Delivered into Service.
2.8.3 The Delivery into Service of any new or enhanced Station Facility shall not adversely affect in any way the functioning of facilities and equipment in any Line Control Room or other control room relating to the National Railway Network, the Underground Network or the British Transport Police. In respect of any such Line Control Room or other control room the new or enhanced Station Facility shall have, as a minimum, the same level of functionality as was present in the Station Facility prior to the replacement or enhancement being carried out. If the new or enhanced Station Facility is delivered with a greater level of functionality then that greater level of functionality shall apply (i) to the Line Control Room by the Latest Implementation Date for the relevant Specified Line Upgrade; and (ii) to any other control room where applicable, by the relevant Latest Completion Date.

Where such functionality is not available in the Line Control Room prior to the relevant Latest Completion Date, the validity of any Capability test undertaken in accordance with Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedures ) shall not be affected.
2.8.4 Immediately following completion of an input specified project, as detailed in Appendices 7, 8 and 14 to 18 ( including, for the avoidance of doubt, Appendix 15A ), Infraco shall be responsible thereafter for the maintenance and renewal of any Facility or other Asset Delivered into Service as a consequence of the Station Modernisation, Enhanced Station Refurbishment, Station Refurbishment, Tactile Installation Works and Platform Resurfacing Works specified in the table below and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to this Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect of any comparable Asset.

2.9 Customer Information at Stations

2.9.1 Infraco shall:

(a) procure, install, maintain, remove and replace ( as required ) all signs and notices displayed at Stations as LUL may reasonably require from time to time, but excluding advertising maps, timetables and other customer information notices which are produced by LUL or TfL; and

(b) ensure that all Customer information at Stations conveyed through Signage, Automated Voice Announcers and Visual Electronic Information Display Panels ( other than information given by free-text messages ) is accurate and consistent with information reasonably provided by LUL from time to time.
2.9.2 Requests for changes to signs and notices displayed at Stations and Signage made in accordance with the provisions of paragraph 2.9.1 above shall be put in writing and sent by the LUL Contract Manager to the Infraco Contract Manager. Infraco shall implement the requested changes within six (6) days of the date upon which the request for changes is sent by the LUL Contract Manager to the Infraco Contract Manager, save that if the request contains a requirement for the manufacture and installation of new vitreous enamel Signage Infraco shall implement the requested changes within fifty-eight (58) days of the date upon which the request for changes is sent by the LUL Contract Manager to the Infraco Contract Manager.
2.9.3 Requests for changes to the Customer information provided by Automated Voice Announcers and Visual Electronic Information Display Panels in accordance with the provisions of paragraph 2.9.1 above shall be put in writing and sent by the LUL Contract Manager to the Infraco Contract Manager. LUL, acting reasonably and following discussion with Infraco, shall set a completion date for the works. Infraco shall complete the works by that date.
2.9.4 Notwithstanding the provisions of paragraphs 2.9.2 and 2.9.3 above, the Infraco Contract Manager may, acting reasonably, request in writing an extension to any of the time periods specified therein, stating the reasons for making the request, and the consent of the LUL Contract Manager to the request for such an extension shall not be unreasonably withheld.
2.9.5 Infraco shall implement all changes to Station Customer information expeditiously, with all due care and skill and in accordance with Good Industry Practice.

3. FACILITIES FAULTS AND FAULT RECTIFICATION FAULTS

3.1 Infraco shall maintain a Fault Reporting Centre ( FRC ) to receive calls made by LUL Staff regarding Facilities Faults and Fault Rectification Faults. The FRC shall answer a minimum of ninety-seven per cent. ( 97% ) of all calls made by LUL Staff to any LUL-dedicated fault reporting telephone number maintained by Infraco within one (1) minute, and shall issue a fault reference number to the caller in the course of the call. Calls shall be deemed to have been answered when an FRC operator responds to the caller.
3.2 By the end of the 1 st Business Day following the end of a reporting period, Infraco shall report to LUL its performance for such period, in accordance with paragraph 3.1 above and paragraphs 3.4, 3.5 and 3.6 below.
3.3 Infraco shall ensure that the FRC is available at any time to answer calls made to the LUL-dedicated fault reporting telephone number.

3.4 For faults relating to assets which are the responsibility of another Infraco, the FRC receiving the call shall log any such fault and ensure that the details of the fault are forwarded to the relevant Infraco and are received by that Infraco's FRC:

(a) ninety seven per cent. ( 97% ) of all such calls within five (5) minutes of the call being received by the receiving FRC, where the fault has caused a Service Disruption, or otherwise
(b) ninety seven per cent. ( 97% ) of all such calls within thirty (30) minutes of the call being received by the receiving FRC. The initial FRC will also record in the FRC Database the date and time the managing Infraco was notified of any such fault.
3.5 For faults relating to assets managed under a PFI Contract or other third party contract, the FRC receiving the call shall log any such fault and ensure that the details of the fault are forwarded to the relevant PFI call centre established under such PFI Contract or in accordance with the notice requirements of the third party contract. Ninety seven per cent. ( 97% ) of such forwarding shall take place within five (5) minutes of the call being received by the FRC. The FRC will also record in the FRC Database the date and time the relevant PFI call centre or sub-contractor was notified of any such fault.
3.6 For faults relating to any LUL Furniture and Office Equipment or LUL Staff Portable Equipment, the FRC receiving the call shall log any such fault and ensure that details of such fault are forwarded to the relevant LUL department nominated by LUL as responsible for dealing with such fault. Ninety seven per cent. ( 97% ) of such forwarding shall take place within thirty (30) minutes of the call being received by the FRC or in the event that the fault is logged outside of the hours during which the relevant LUL department is staffed, as notified by LUL to Infraco from time to time, within thirty (30) minutes of the commencement of the hour from which the relevant LUL department is staffed.
3.7 LUL acknowledges that Infraco shall be exempt from Abatement Service Points calculated in accordance with paragraph 6.5A of Section Two of the Performance Measurement Code for the period commencing on the Transfer Date and ending on the earlier of: (a) completion of the thirteenth Payment Period thereafter; and

(b) completion of the second Payment Period thereafter during which Infraco meets the service requirements set out in paragraph 3.1, 3.4, 3.5 and 3.6 above.
3.8 Each fault reported to the FRC shall be categorised either as a Facilities Fault or a Fault Rectification Fault in accordance with paragraphs 3.9 and 3.10 below.
3.9 Each Facilities Fault reported to the FRC shall be categorised by reference to the list below. Infraco shall rectify all reported Facilities Faults within the most practicable time possible.

3.11 Notwithstanding paragraph 3.10 above, from the Transfer Date until twelve (12) months thereafter, Infraco shall not be abated Service Points for Train Rolling Stock faults and Train Rolling Stock cleaning faults as set out in paragraph 6.5.9 of Section Two of the Performance Measurement Code.

For the avoidance of doubt, this paragraph 3.11 does not absolve Infraco from its obligations to clear Train Rolling Stock faults and Train Rolling Stock cleaning faults within the Standard Clearance Times as set out in the table within paragraph 3.10 above.
3.12 In the event there are Infraco cleaning staff on site at a Station where an incident of litter and/or Spillage occurs, LUL can request that the cleaning staff clean up such litter and/or Spillage within fifteen (15) minutes. If not cleaned up within fifteen (15) minutes, the litter and/or Spillage shall be reported as a litter and Spillage fault and rectified within the Standard Clearance Time as provided under paragraph 3.10 above.
3.13 Where a fault relating to Fault Rectification Faults listed in the table in paragraph 3.10 above has (a) a material impact on the Ambience of a Station, (b) a significant safety or operational implication, or (c) requires prompt rectification to satisfy statutory requirements, LUL may prescribe a reasonable Special Clearance Time to the rectification of the fault which shall be shorter in duration than the Standard Clearance Time specified in paragraph 3.10 above. Where Special Clearance Times have been specified, Infraco shall rectify all faults within such Special Clearance Times.
3.14 Following receipt of a call reporting a fault and the issuance of a fault reference number incident number by the FRC, the FRC shall respond as soon as reasonably possible and, in any event, within twenty-four (24) hours of such receipt to the member of LUL Staff or such other person who has responsibility therefor, reporting the fault, the predicted time that the fault will be rectified. If the predicted time of rectification changes following inspection of the fault by Infraco or for any other reason that Infraco may deem necessary, Infraco shall advise LUL as soon as reasonably possible of such amended predicted rectification time.
3.15 LUL may agree a temporary fix where the fix is deemed to adequately provide the functionality of the faulty or defective Asset. Under these circumstances the fault will be Closed-out and a new fault logged by FRC. The Standard Clearance Time as set in paragraph 3.10 of this Schedule 2.1 will thus be applicable from the date and time at which the new fault is logged by the FRC.
3.16 The FRC shall ensure that faults, upon rectification, are Closed-out in accordance with the Performance Measurement Code.

4. PROVISION OF EMERGENCY SERVICES BY INFRACO

4.1 If requested by LUL, Infraco shall provide, or procure the provision of, Emergency Services as quickly as is reasonably practicable in all the circumstances and with the degree of urgency commensurate with the severity of the situation for which the Emergency Services have been requested, taking into account the threat ( or perceived threat ) of injury to any person, the possibility of further damage, and the level of any Disruption caused.
4.2 Except in relation to the Assets and infrastructure provided and maintained by Infraco, LUL shall be liable to compensate Infraco for reasonable costs incurred in connection with the provision of Emergency Services.

5. LOST PROPERTY

5.1 Subject to paragraph 5.2, Infraco shall deliver all lost property found or handed to any of its Staff to the Station Supervisor at the nearest Station to where the lost property is found. All lost property must be handed to the Station Supervisor within twenty four (24) hours of it being found or handed to a member of Infraco Staff. Pending delivery of lost property to the Station Supervisor, Infraco shall take all reasonable steps to safeguard and secure all lost property having regard to its nature and value.
5.2 If Infraco finds any animal ( excluding rodents and human beings ), it shall deliver it, as soon as reasonably practicable, to the Royal Society for the Prevention of Cruelty to Animals ( RSPCA ). Infraco shall then notify the Station Supervisor at the Station nearest to where the animal was found that such animal has been handed to the RSPCA, including quoting any reference number given by the RSPCA.
5.3 Infraco shall refer any member of the public making an enquiry in relation to lost property to the Lost Property Office located at 200 Baker Street, London, NW1 5RZ, or such other addresses as LUL may from time to time notify Infraco in writing.

6. MINOR WORKS

6.1 To the extent that Infraco is not otherwise required to do so pursuant to this PPP Contract, Infraco shall carry out all Minor Works upon receipt of a written request ( a Minor Works Request ) from LUL provided that the cost of carrying out Minor Works to implement such Minor Works Request pursuant to paragraph 6.2 below, when added to the costs of carrying out Minor Works to implement Minor Works Requests which have been submitted by LUL in the same Contract Year, shall not exceed £4,000,000. Future replacement of these Assets will be dealt with as new Minor Works requests unless they have failed to achieve their anticipated life expectancy or where the anticipated life expectancy would result in the future replacement being after the next Periodic Review, in which case they shall be replaced by the Infraco at its own cost. 6.1(a) The costs of Minor Works should be the prime cost only and should not include profit margin, overhead allocation or the ongoing maintenance costs of assets Delivered into Service via this regime. These costs are to be included as part of the Baseline ISC.
6.2 (a) The Infraco Contract Manager shall provide the LUL Contract Manager with a written cost estimate for carrying out the Minor Works within ten (10) Business Days of receipt of a Minor Works Request. This written cost estimate shall include, where applicable, an anticipated life expectancy for each Asset which would be Delivered into Service by such Minor Works ( for the purposes of this clause 6.2(a), anticipated life expectancy shall be based on then current industry best practices ).

(b) The LUL Contract Manager shall respond in writing to Infraco within ten (10) Business Days of receipt of Infraco's cost estimate for carrying out Minor Works stating whether he accepts or rejects such cost estimate.

(c) Where the LUL Contract Manager accepts Infraco's cost estimate pursuant to paragraph 6.2(b) above, Infraco shall complete such Minor Works within twenty (20) Business Days of receipt of LUL's written acceptance of such cost estimate or within such other period of time as the Contract Managers may agree from time to time.

(d) Notwithstanding the provisions of sub-paragraphs (a) and (c) above, the Infraco Contract Manager may at any time, acting reasonably, request in writing an extension to any of the time periods specified therein, and the consent of the LUL Contract Manager to the request for such an extension shall not be unreasonably withheld.

(e) Removal of Graffiti and Unauthorised Stickers on Trackside Structures not set out in paragraph 1.4(h), sub-paragraph (ii) of this Schedule 2.1 shall be dealt with as Minor Works in accordance with this paragraph 6.

(f) The cost of Minor Works, together with Service Points allocated to Infraco in accordance with paragraphs 6.2(a) and (c) above and Schedule 8 of the Performance Measurement Code ( Service Points ), will accrue to the period in which the Minor Works are complete.
6.3 Minor Works shall be carried out by Infraco: (a) in compliance with any reasonable requirements requested by LUL in the Minor Works Request;

(b) expeditiously and, in any event, in compliance with such reasonable completion dates as may be set out in the Minor Works Request;

(c) with all due care and skill; and

(d) in accordance with Good Industry Practice.
6.4 Not later than four (4) weeks following the end of each Contract Year, LUL shall notify Infraco in writing of the total cost of carrying out Minor Works ( as determined pursuant to clause 6.2 above ) that LUL have requested under clause 6.1 during that Contract Year. Following delivery of such written notification, but subject to the resolution of any dispute relating to such notice, LUL shall be entitled to deduct from the payments due to Infraco on the thirteen (13) Payment Dates next following the date on which notice is delivered, an amount equal to one thirteenth of the difference, if any, between the total cost of carrying out such Minor Works and £4,000,000.
6.5 Immediately following completion of Minor Works in accordance with this paragraph 6, Infraco shall be responsible thereafter for the maintenance and renewal of any new Facility or other Asset Delivered into Service as a consequence of the Minor Work and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect to any comparable Assets.

6A. INTERMEDIATE WORKS

6A.1 To the extent that Infraco is not otherwise required to do so pursuant to this PPP Contract, Infraco shall carry out all Intermediate Works upon receipt of a written request ( an Intermediate Works Request ), which Intermediate Works Request shall specify that LUL proposes to exercise an LUL Specified Right, provided that the cost of carrying out Intermediate Works to implement such Intermediate Works Request pursuant to paragraph 6A.3 below, when added to the costs of carrying out Intermediate Works to implement Intermediate Work Requests which have been submitted by LUL in the same Contract Year, shall not exceed £5,000,000.
6A.2 For the avoidance of doubt, the costs of carrying out Intermediate Works that Infraco may be required to undertake pursuant to this paragraph 6A are in addition to the costs of any Minor Works that Infraco may be required to undertake pursuant to paragraph 6 of this Schedule 2.1 and, further for the avoidance of doubt, LUL may require Infraco to carry out Minor Works in accordance with paragraph 6 of this Schedule 2.1 without exercising an LUL Specified Right.
6A.3

(a) Infraco shall provide LUL with a written cost estimate for the proper and reasonable costs of carrying out the Intermediate Works within thirty (30) Business Days of receipt of an Intermediate Works Request

(b)

(i) LUL shall respond in writing to Infraco within twenty (20) Business Days of receipt of Infraco's cost estimate for carrying out Intermediate Works stating whether it agrees or disputes such cost estimate. In the event that LUL agrees the estimate, it shall advise Infraco that agreement to proceed is conditional upon LUL providing subsequent confirmation of release of funds, such confirmation to be given within forty (40) Business Days from the date of the written conditional acceptance of the Infraco's estimate. In the event that LUL disputes such estimate any such dispute shall be determined in accordance with clause 29.7 of the PPP Contract ( mutatis mutandis ).

(ii) If LUL disputes Infraco's cost estimate for carrying out Intermediate Works then, unless the parties have agreed that the Intermediate Works be carried out by an Alternative Intermediate Works Provider pursuant to paragraph 6A.6 below and notwithstanding that such dispute may have been referred to resolution in accordance with sub-paragraph (i) above, Infraco shall carry out the Intermediate Works in accordance with this paragraph 6A and LUL will reimburse Infraco for those costs incurred by Infraco in carrying out the Intermediate Works which are not in dispute in accordance with paragraph 6A.5 below.

(c) Where LUL accepts Infraco's cost estimate pursuant to paragraph 6A.3(b) above, Infraco shall complete such Intermediate Works as soon as reasonably practicable and within six (6) months ( or such longer time as the parties agree ) of receipt of LUL's written acceptance of such cost estimate or within such other period of time as the parties may agree from time to time.

(d) Notwithstanding the provisions of sub-paragraphs (a) and (c) above, Infraco may at any time, acting reasonably, request in writing an extension to any of the time periods specified therein, and the consent of LUL to the request for such an extension shall not be unreasonably withheld.

(e) Any Service Points allocated to Infraco in accordance with Schedule 8 of the Performance Measurement Code ( Service Points ) will accrue to the Payment Period in which the failure to deliver occurred.

6A.4 Intermediate Works shall be carried out by Infraco: (a) in compliance with any reasonable requirements requested by LUL in the Intermediate Works Request;

(b) expeditiously and, in any event, in compliance with such reasonable completion dates as may be set out in the Intermediate Works Request;

(c) with all due care and skill; and

(d) in accordance with Good Industry Practice.
6A.5 LUL will reimburse Infraco for costs incurred by Infraco in carrying out the Intermediate Works upon completion thereof and in accordance with the estimate therefore agreed or determined pursuant to paragraph 6A.3 above.
6A.6 Notwithstanding any other provision in this paragraph 6A, the parties may agree at any time that any Intermediate Works, or part thereof, be carried out by an Alternative Intermediate Works Provider.
6A.7 Immediately following completion of Intermediate Works in accordance with this paragraph 6A ( whether or not such Intermediate Works have been performed by Infraco or an Alternative Intermediate Works Provider, and whether or not the terms for compensating Infraco for any Increased Infraco Cost and/or the terms for dealing with any Increased Infraco Risk under clause 6A.8 below have been agreed ), Infraco shall be responsible thereafter for the maintenance and renewal of any new Facility or other Asset Delivered into Service as a consequence of the Intermediate Works and such new Facility or other Asset shall be made Available to LUL, all in accordance with the terms of the PPP Contract and the parties shall agree such changes to Schedule 2.1 as may be necessary to effect the foregoing, with the intention that the necessary changes shall be those which would place upon Infraco comparable obligations in respect of such new Facility or other Asset as it then has with respect to any comparable or analogous Assets.
6A.8 The terms for: (a) compensating Infraco for any Increased Infraco Cost; and/or

(b) dealing with the Increased Infraco Risk, so as to mitigate substantially the adverse effects of the Increased Infraco Risk,
which would occur as a result of the provisions of clause 6A.7 above shall be included in the determination of such matters relating to the relevant Intermediate Works in accordance with clause 17 ( LUL Specified Rights ) of the PPP Contract.
6A.9 Where any Facility or Asset is Delivered into Service as a consequence of Intermediate Works performed by an Alternative Intermediate Works Provider, LUL shall use reasonable endeavours to make available to Infraco the benefits of any rights that LUL may have in respect of that Facility or Asset under any agreement or arrangement with the Alternative Intermediate Works Provider and/or any third party ( including, without limitation, any professional manufacturer's or supplier's warranties and/or indemnities ).

6B MAJOR ENHANCEMENT SERVICES AND WORKS

6B.1 Where, under clause 5.1 of the Major Enhancement Agreement, LUL has requested the Infraco ( by a written Requirements Statement ) to provide Major Enhancement Services, the Infraco shall indicate its willingness to perform all or part of the Major Enhancement Services requested within thirty (30) Business Days of receiving the Requirements Statement.
6B.2 In the event that the Infraco confirms its willingness to perform such Major Enhancement Services, Infraco shall provide LUL with a written estimate of the ME Services Price for carrying out the Major Enhancement Services in accordance with clause 6.1 of the Major Enhancement Agreement within thirty (30) Business Days of confirming that position, unless the service relates to a Line Extension Project in which case the Infraco shall advise LUL within ten (10) working days of the time it considers it reasonably required to provide such an estimate.
6B.3 Notwithstanding the provisions of sub-paragraphs 6B.1 and 6B.2 above, the Infraco Contract Manager may at any time, acting reasonably, request in writing an extension to any of the time periods specified therein, and the consent of the LUL Contract Manager to the request for such an extension shall not be unreasonably withheld.
6B.4 Pursuant to clause 5.3 of the Major Enhancement Agreement, Infraco shall co-operate with LUL in developing the ME Terms for implementing the Major Enhancement Works.
6B.5 Any Service Points allocated to Infraco in accordance with Schedule 8 of the Performance Measurement Code ( Service Points ) will accrue to the period in which failure to deliver occurred.

7. LIMIT OF LUL REMEDIES

7.1 Except as otherwise provided in this clause 7, in the event of a failure by Infraco as set out hereafter in sub-paragraphs (a) to (g), the remedy available to LUL shall be limited to the payment adjustments ( if any ) pursuant to Schedule 4.1 ( Performance Payment Mechanism ):

(a) failure to make any of the Train Facilities or Station Facilities Available, the result of which is any of the Disruption types, as more particularly described in Table 1 of Part A of Schedule 5 of the Performance Measurement Code; or

(b) failure to ensure that those Train Facilities set out in sub-paragraphs (a) to (h) of paragraph 1.3 above and set out in Appendix 4 ( Train Staff and Train Service Facilities ) are Available during the period from the time of Train Delivery to the time of Train Return and are Available to LUL Staff at all other times, subject to any rights of access having been granted in accordance with the Access Code; or

(c) failure to ensure that, in relation to each Station, or, where Appendix 13C ( Station Facilities at Non JNP Stations ) applies, each Non-JNP Station, those Station Facilities set out in paragraph 2.2 and set out in Appendix 13 ( Station Facilities ) are Available during the applicable Station Opening Hours and are Available for LUL Staff at all other times, subject to any rights of access having been granted in accordance with the Access Code; or

(d) failure to meet the Ambience requirements in relation to Train Facilities during the period from the time of Train Delivery to the time of Train Return as set out in paragraph 1.4, or to meet the Ambience requirements in relation to Station Facilities during the applicable Station Hours, as set out in paragraph 2.3; or

(e) failure to meet the requirements in relation to the minimum Train Ambience scores for each Line as set out in paragraph 1.4A or the minimum Station Ambience scores for each Station as set out in paragraph 2.4; or

(f) failure to meet the requirements in relation to Capability as described in paragraphs 1.1, 2.1 and 3.1 of Section Two of the Performance Measurement Code; or

(g) failure to meet the requirements in relation to Specific Projects as set out in Appendices 5A, 7, 8, 14, 15, 16, 17 and 18.

7.2 Without prejudice to any rights or remedies LUL may have pursuant to paragraph 23.2 of the Service Contract, in the event of failure by Infraco as set out in paragraph 7.1 above, LUL shall be entitled to take remedies pursuant to clause 22 of the Service Contract ( Failure to Comply with Obligations ), to take remedies pursuant to clause 23 of the Service Contract ( LUL Step-In Rights ) or to take such steps as may be open to it in accordance with the Safety Agreement, the LUL Safety Case or safety-related Standards to the extent that as a result of such failure or such failure taken together with any other failures, the safe operation of the Underground Network or the safety of LUL's Customers, LUL Staff or of any other persons is, or may be, materially affected.
7.3 Without prejudice to any rights or remedies LUL may have pursuant to paragraph 23.2 of the Service Contract, in the event of a failure by Infraco as set out in sub-paragraphs (a) through (g) of paragraph 7.1 above, LUL shall, subject to paragraph 7.5, also be entitled to take remedies pursuant to clause 22 of the Service Contract ( Failure to Comply with Obligations ) or to take remedies pursuant to clause 23 of the Service Contract ( LUL Step-In Rights ) provided that: (a) in the case of a failure set out in sub-paragraphs (a) or (d) of paragraph 7.1, such failure taken together with any other failures results in Infraco's level of Availability or Ambience performance being above ( for Availability ) or below ( for Ambience ) Unacceptable, as determined in accordance with clause 4 ( Availability ) and clause 5 ( Ambience ) of Section Two of the Performance Measurement Code, as measured against the parameters defined in accordance with paragraphs 3 ( Availability ) and 4 ( Ambience ) of Schedule 4.1 ( Payment );

(b) except as hereafter provided, in the case of a failure classified as a Facilities Fault or a Fault Rectification Fault in accordance with paragraphs 3.9 and 3.10 of this Schedule 2.1, LUL shall be limited to the payment adjustments ( if any ) pursuant to Schedule 4.1 ( Performance Payment Mechanism ). Notwithstanding the foregoing, in the event that any such fault is not Closed-out within a reasonable period of time, LUL shall be entitled to take remedies pursuant to clause 22 of the Contract ( Failure to Comply with Obligations ) and clause 23 of the Contract ( LUL Step-In Rights ) provided that such remedies may only be exercised in the context of the individual fault and not the calculated Infraco performance as determined in accordance with Appendix 6 of Schedule 2.2;

(c) in the case of a failure set out in sub-paragraph (e) of paragraph 7.1, Infraco fails to meet the required minimum Train Ambience score as set out in Appendix 6A or the required minimum Station Ambience score as set out in Appendix 6B, and as measured against the aggregate JNP Ambience performance levels defined in accordance with paragraph 4 ( Ambience ) and Appendix 2 ( Payment Parameters ) to Schedule 4.1 ( Payment ); and

(d) in the case of a failure set out in sub-paragraph (f) of paragraph 7.1, such failure taken together with any other failures results in Infraco's level of Capability in any Payment Period:

(i) being below Unacceptable, as set out in Appendix 2 of Schedule 4.1 ( Payment Parameters ), and Infraco fails to demonstrate to LUL an increase in the corresponding measure such that the level of performance is above Unacceptable prior to the completion of the succeeding three (3) Payment Periods; or

(ii) being below Benchmark, as set out in Appendix 2 of Schedule 4.1 ( Payment Parameters ), and Infraco fails to demonstrate to LUL an increase in the corresponding measure such that the level of performance is above Benchmark prior to the completion of the succeeding ten (10) Payment Periods.

in each case, and as measured against the parameters defined in accordance with paragraphs 2 ( Capability ) of Schedule 4.1 ( Payment ).
7.4 Without prejudice to any rights or remedies LUL may have pursuant to paragraph 23.2 of the Service Contract, in the event of a failure by Infraco as set out in sub-paragraphs (a) or (d) of paragraph 7.1 above, LUL shall, subject to paragraph 7.5, also be entitled to issue a Corrective Action Notice and take any other remedies available to it pursuant to clause 22 of the Service Contract ( Failure to Comply with Obligations ) but not any remedies pursuant to clause 23 of the Service Contract ( LUL Step In Rights ) to the extent that such failure taken together with any other failures results in Infraco's level of Availability or Ambience performance being above ( for Availability ) or below ( for Ambience ) Benchmark, as determined in accordance with clause 4 ( Availability ) and clause 5 ( Ambience ) of Section Two of the Performance Measurement Code, and as measured against the parameters defined in accordance with paragraphs 3 ( Availability ) and 4 ( Ambience ) or Schedule 4.1 ( Payment ).
7.5 For the purposes of paragraphs 7.3 and 7.4, the performance of Infraco will be attributable to the inherent variability of a measure, and so LUL will not be entitled to exercise the remedies otherwise available to it in accordance with those paragraphs, to the extent that it is agreed or determined that the failures giving rise to the level of performance being above or below the relevant indicator ( as the case may be ) occurred as a result of the inherent variability of the performance of the Assets as reflected under and in accordance with the Performance Measurement Code and not as a result of any failure of Infraco to perform any Infraco Obligation in an efficient and economic manner and in accordance with Good Industry Practice, having regard ( amongst other things ) to: (a) the fact that the nature of the Assets is such that failures such as those described in paragraph 7.1 can occur in an unpredictable manner ( including as to time and location ) and that a small number of such failures can have a substantial effect on Infraco's performance as measured under the methodology of the Performance Measurement Code; and

(b) the fact that the nature of the Assets and the manner of measurement are such that even were the Underground Network under the stewardship of an Infraco performing the obligations of Infraco in an efficient and economic manner and in accordance with Good Industry Practice, some degree of failure of the nature described in paragraph 7.1 is possible.
7.6 Notwithstanding anything else in this clause 7, LUL shall be entitled to take any remedy available to it in respect of events giving rise to a failure enumerated in clause 7.1 above, to the extent that such events were caused by a breach of Infraco Obligations ( other than a breach of Infraco Obligations as set out in clause 7.1 ).
7.7 For the purposes of paragraphs 7.3 and 7.4, any Corrective Action Notice issued in accordance with LUL's entitlement as set out in such paragraphs shall specify a time period within which the breach is to be remedied which, notwithstanding the provisions of clause 22.1(b), shall not expire prior to the first anniversary of the Transfer Date.

8. PLATFORM DE-ICING

8.1 Subject to Infraco complying with its obligations to supply de-icing materials to relevant stations LUL and Infraco shall, diligently and in accordance with Good Industry Practice, spread de-icing materials on Station Facilities as required to alleviate any hazard or potential hazard arising from ice on Station Facilities.

APPENDIX 2 - Train Preparation Procedures

Definitions

1 In this Appendix:

Duty Schedule
means the work roster prepared by LUL for each Train operator showing the times of the start and finish of a Train operator's work and the locations of such work;

Major Change
means a change to a depot layout or walkway ( as specified in the Manual ) which affects the Walking Time or the Duty Schedule in any way;

Minor Change
means a change to a depot layout or walkway ( as specified in the Manual ) which does not affect the Walking Time or the Duty Schedule; and

Walking Time
means the time taken for a Train operator to move from the Train Crew Depot to the stabled Train on which the Train operator is scheduled to work.

Train Preparation Procedures

2 The train preparation procedures referred to in paragraph 1.2.1 of this Schedule shall include the following: (a) the location ( including road number ) and the formation of all Trains ( carriage numbers ) shall be made available to LUL at least one hour before the first Train is scheduled to enter service;

(b) if Infraco makes any Minor Changes, Infraco shall notify LUL in writing of such Minor Changes prior to such Minor Changes coming into effect; and

(c) if Infraco intends to make any Major Changes, such Major Changes shall only come into effect with the prior agreement of LUL.

APPENDIX 7 - Enhancements to Train Facilities

APPENDIX 7A - DELIVERY OF ENHANCEMENTS

1. Delivery of enhancements

1.1

Infraco shall Deliver into Service the enhancements set out in Appendix 7B in respect of each JNP Line by the Latest Completion Date as specified in the table below.

1.2 To the extent that Delivery into Service of the enhancements set out in this Appendix necessitates a change to the details set out in Appendix 4 ( Train Staff and Train Service Facilities ), those tables shall be amended accordingly.

APPENDIX 7B - Enhancement Requirements

1. VISUAL ELECTRONIC INFORMATION DISPLAY PANEL - TRAIN CARRIAGE

1.1 There shall be a Visual Electronic Information Display Panel ( Display Panel ) of the same or a similar position and size as the existing Display Panels ( such as located in the Jubilee Line 1996 tube stock or Northern Line 1995 tube stock ) present in each carriage of each Train which meets the requirements of paragraphs 1.2 and 1.3 below.
1.2 Customers shall be able to see a Display Panel from all parts of the carriage.
1.3 Each Display Panel shall have the minimum functionality of showing the following: (a) the name of the JNP Line;

(b) the final destination and routing of the Train;

(c) the name of the next Station at which the Train will stop;

(d) information relevant to that Station regarding interchange facilities with other Lines and with the National Railway Network;

(e) Station-specific information including information that certain doors will not open because of a short platform;

(f) the names of major landmarks and tourist attractions served by the next Station at which the Train will stop which shall be able to be changed automatically depending on the time of day and overridden by the Line Control Office;

(g) real-time service disruption information relayed by the Line Control Office or by the Train operator who can select standards messages;

(h) static, flashing and scrolling textual information and symbols plus timed messages; and

(i) messages that are displayed only as the Train travels between Stations and only whilst the Train doors are open.

2. VISUAL ELECTRONIC INFORMATION DISPLAY PANEL - TRAIN EXTERIOR

2.1 On the front and back of each Train there shall be a Visual Electronic Information Display Panel ( Display Panel ) of the same or a similar position and size as the existing Display Panels ( such as located in the Jubilee Line 1996 tube stock or Northern Line 1995 tube stock ) with the minimum functionality of showing: (a) the name of the JNP Line; and

(b) the final destination and routing of the Train.
2.2 On each side of each car of the Train there shall be a Display Panel which shall be positioned such that it does not interfere unreasonably with the structure or kinematic envelope of the car. The Display Panel shall have the minimum functionality of showing: (a) the name of the JNP Line; and

(b) the final destination and routing of the Train.

3. AUDIBLE INFORMATION

3.1 It shall be possible for live and pre-recorded announcements to be made via a Public Address System to Customers and LUL Staff in every carriage of every Train.
3.2 Pre-recorded announcements shall be made using an Automated Voice Announcer.
3.3 It shall be possible for the pre-recorded announcements made by the Automated Voice Announcer to be overridden, if necessary, and to be timed so that they are only broadcast as a Train travels between Stations or only whilst Train doors are open. Announcements may be overridden by the Train Operator.
3.4 The Automated Voice Announcer shall have the minimum functionality of automatically announcing information including: (a) the name of the JNP Line;

(b) the final destination and routing of the Train;

(c) if the Train is between Stations, the name of the next Station at which the Train will stop, or, if the Train has stopped at a Station, the name of that Station;

(d) information relevant to the Station referred to in sub-paragraph (c) above regarding interchange facilities with other Lines and with the National Railway Network;

(e) Station-specific information including information that certain doors of the Train will not open due to a short platform;

(f) the names of major landmarks and tourist attractions served by the next Station at which the train will stop which shall be able to be changed automatically depending on the time of day and overridden by the Line Control Office;

(g) real-time service disruption information;

(h) on approaching a terminal Station, announcing the fact that the Train will be terminating at that Station and giving an "All change" message; and

(i) when the Train doors are open at Stations where there is either a vertical or horizontal gap of six (6) inches or more between the Train step and the platform edge, giving the warning "Please mind the gap between the train and the platform".
3.5 At every Station, as the Train doors are closing, a tone or buzzer shall sound.
3.6 Ambient noise detection shall be provided such that the volume of an announcement is adjusted automatically to take account of the level of ambient noise so that the announcement can be heard clearly.

4. SECURITY MONITORING EQUIPMENT

4.1 All Trains shall have security monitoring equipment such that a minimum of ninety per cent ( 90% ) of the air-space inside each Train carriage is visible to the security monitoring equipment.
4.2 The security monitoring equipment shall: (a) be sited in positions best suited to avoid being damaged or obscured;

(b) be constructed in such a way as to minimise the possibility of vandalism;

(c) have associated monitoring equipment which;
(i) enables the Train operator to view the image(s) that are being produced by the security monitoring equipment in a carriage on that Train ( carriage to be selectable by the Train operator ); and

(ii) will automatically display the image(s) produced by the security monitoring equipment in a carriage in which and emergency help facility has been operated;

(d) have recording equipment that is able to record images in order to assist in the prosecution of criminal offenders; and

(e) produce colour images which can be enhanced by others for identification purposes in the prosecution of criminal offenders.
4.3 There shall be two (2) clear and permanent signs displayed in each seating area in each Train carriage explaining that security monitoring equipment is in continuous use, that the images are being recorded and that they can be used in the event of an incident to assist in the prosecution of criminal offenders.

5. EMERGENCY HELP FACILITIES

5.1 In each carriage of every Train, there shall be one (1) emergency help facility in each single-door vestibule and two (2) emergency help facilities in each double-door vestibule which meet the requirements of paragraph 5.2 below.
5.2 The emergency help facility shall: (a) be instantly recognisable as such;

(b) be constructed in such a way as to minimise the possibility of vandalism;

(c) have a talk-back facility for the use of the Train operator;

(d) indicate to the Train operator its location when it is operated;

(e) inform the Train operator of any incident, who will then decide, using advice from others as necessary, if it is necessary to halt the Train; and

(f) be at a height such that it can be reached and operated by Customers sitting in wheel-chairs.
5.3 At each emergency help facility there shall be a clear and permanent sign explaining: (a) how to use the emergency help facility; and

(b) the response that the Customer can expect.
5.4 There shall be two (2) clear and permanent signs displayed in each seating area in each Train carriage explaining that: (a) emergency help facilities are available; and

(b) LUL Staff have the means to communicate with control facilities.
6. ARM RESTS
An arm rest shall be provided between each seat on all static longitudinal seating.

APPENDIX 8 - Refurbishment of Trains and Staff Accommodation

1. GENERAL

1.1 In this Appendix, the following expressions have the following meanings:

Latest Completion Date
means each date specified in the column of the table in paragraph 3 below headed "Latest Completion Date"; and

Train Refurbishments
means the replacement of Trains and works to refurbish Trains which shall include those works in relation to Train saloons and Train cabs as specified in paragraphs 2.3 and 2.4 below.

2. TRAIN REFURBISHMENTS

2.1 By each of the Latest Completion Dates specified in the table in paragraph 3 below, Infraco shall implement the Train Refurbishments in respect of each Train.
2.2 Notwithstanding the provisions of this Appendix 8, LUL shall, at the request of Infraco, agree that certain Train Refurbishment works need not be carried out, agree to the method by which work is delivered, agree to changes being made to the scope of works that this Appendix 8 requires Infraco to carry out or agree to changes in the timing of completion of such works Provided that Infraco can demonstrate to the satisfaction of LUL that: (a) repair, replacement or other works had been carried out within the three (3) year period prior to the relevant Latest Completion Date and such works were equivalent to those which Infraco is required to carry out under this Appendix 8; or

(b) specific Train Facilities or finishes which require refurbishment are in good order and fit for purpose and, therefore, Train Refurbishment works are not required in relation to such Train Facilities or finishes; or
Provided that Infraco can demonstrate to the satisfaction of LUL that such changes to the works, scope or timing of works required would result in reduced Customer disbenefit ( by use of the appraisal methodology which is described in the Business Case Development Manual ).

Works in relation to the Train saloon

2.3 Train Refurbishments shall include the following works to the Train saloon: (a) Delivery into Service of the enhancements to Train Facilities as specified in Appendix 7 if such enhancements have not been Delivered into Service by the Latest Completion Date;

(b) replacement or remodelling of saloon interior surfaces ( panelling and ceilings ) and lighting;

(c) replacement of saloon floor covering;

(d) measures to reduce the impact of scratched glass;

(e) replacement or remodelling of seating or saloon layout. Arm rests shall be provided on all static longitudinal seating in Trains where, and to the same extent as, such arm rests are provided at the Transfer Date. For replacement Trains, arm rests shall be provided between each seat on all static longitudinal seating;

(f) for replacement Trains only, installation of saloon end windows;

(g) replacement or remodelling of Customer hold points;

(h) works to enhance ventilation and improve airflow through the Train saloon without using air-conditioning. LUL acknowledge that these works are subject to constraint on space, structure and installed power and do not include changes to tunnel ventilation;

(i) works to reduce noise. LUL acknowledge that these works are subject to constraints presented by existing door and carbody design and do not include modifications to operational equipment, such as compressors and inverters;

(j) refreshing external corporate livery;

(k) for replacement Trains only, provision of Customer door control open and close buttons, with Train operator override capability;

(l) reviewing or remodelling of the positioning of publicity and information material and commercial advertisements in order to make them clearly visible and readily distinguishable from each other; and

(m) specifically to assist the mobility-impaired, the installation of or improvements to handrails and highlighting of obstructions.

Works in relation to the Train cab

2.4 Train Refurbishments shall include the following works to the Train cab: (a) replacement of panelling;

(b) replacement of the floor;

(c) replacement of the driver's seat and instructor's seat;

(d) reviewing or enhancing cab ergonomics ( limited to the Train operator's seat and any other seat that is provided, together with all controls and monitors which are used by a Train operator or other LUL staff member during normal operation or emergency situations );

(e) provision of air-conditioning ( or in the case of refurbishment of existing Train Rolling Stock which already has Train cab air-conditioning, provision which meets the relevant LUL Standard ); and

(f) provision of Missile-Proof Glazing. LUL acknowledge that these works are subject to constraints presented by the existing framing.

4. REFURBISHMENT OF TRAIN STAFF ACCOMMODATION

4.1 By the date of the first Periodic Review, Infraco shall carry out works to redecorate and refurbish all Staff Accommodation comprised within Train Facilities.
4.2 Infraco shall carry out further refurbishment and redecoration works to all such Staff Accommodation by the Enhanced Refurbishment Completion Dates or ( as applicable ) Refurbishment Completion Dates in accordance with paragraph 6 of Appendix 15 ( Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment ) of this Schedule 2.1.

APPENDIX 9 - Delivery into Service of New and Enhanced Facilities

1. PRACTICAL COMPLETION

Paragraphs 1 and 2 of this Appendix 9 shall apply to the obligations set out in Appendices 7, 8, 14, 15, 16 and 17 to this Schedule 2.1 and paragraphs 3 to 9 shall apply to the obligations set out in Appendix 15A:
1.1 Infraco shall provide to LUL fourteen (14) days advance notice in writing of the date upon which it genuinely considers Practical Completion of the works described in the Work Package Plan(s) developed in relation to the applicable obligation will be achieved. Where Infraco reasonably considers that it will not be able to achieve Practical Completion by the advised anticipated date it shall so advise LUL in writing together with notice of the revised date by which Infraco genuinely considers it will achieve Practical Completion, and shall continue to do so until Practical Completion is in Infraco's opinion achieved.
1.2 When Infraco considers that it has achieved Practical Completion it shall notify LUL forthwith in writing and present to LUL a draft Snagging List and ( for LUL's information only ) a programme for completing the Snagging Items ( both compiled by Infraco using Good Industry Practice ) in relation to those works.
1.3 LUL may in its discretion inspect the relevant works anytime after receipt of the first advance notice referred to in paragraph 1.1 above, and shall ( acting reasonably ) advise Infraco in writing as to whether it agrees that the works are Practically Complete within fourteen (14) days after receipt of the notification referred to in paragraph 1.2 above.
1.4 Where LUL advises Infraco that LUL does not accept that the works are Practically Complete, it shall at the same time provide to Infraco the reasons why Practical Completion has not been achieved, in which case Infraco shall repeat the requirements set out on paragraph 1.2 until Practical Completion is achieved. Where LUL advises Infraco that LUL accepts that the works are Practically Complete, LUL shall also ( acting reasonably ) advise Infraco as to whether it accepts the Snagging List provided by Infraco pursuant to paragraph 1.2 above, and where it does not, shall provide reasons and a revised Snagging List with which Infraco shall comply. The date upon which LUL so advises Infraco or alternatively issues a revised Snagging List is hereafter referred to as the Snagging List Date .
1.5 Infraco shall thereafter perform the works necessary to rectify and/or complete the Snagging Items on the Snagging List, and shall provide to LUL a four (4)-weekly status report on Snagging Items, commencing four (4) weeks after the first Payment Period end following the Snagging List Date.
1.6 Infraco shall, where at the conclusion of four (4) Payment Periods after the first Payment Period end following the Snagging List Date there remain any Snagging Items outstanding, be abated thereafter an amount of £10,000 per Payment Period ( in accordance with Clause 6.4 of Schedule 4.1 ( Performance Payment Mechanism ) ), until all Snagging Items have been completed or until the provisions of paragraph 1.7 of this Appendix 9, are activated ( whichever is the earlier ). For the avoidance of doubt, Infraco shall be abated for the full sum of £10,000 in the relevant Payment Period where any Snagging Items existed at the commencement of that Payment Period, regardless of how soon within that Payment Period Infraco completed the remaining Snagging Items.
1.7 LUL will report any Snagging Items still outstanding ten (10) Payment Periods after the first Payment Period end following the relevant Snagging List Date to the Fault Reporting Centre, and those Snagging Items shall thereafter be addressed by way of the Fault Rectification procedure set out in paragraph 3 of Schedule 2.1.
1.8 Where the failure to complete Snagging Items is due to a Delay Event, Infraco shall be entitled ( without being liable for abatements under paragraph 1.6 ) to such additional time as is reasonable for completion of the Snagging Items given the nature and extent of the delay caused by the Delay Event.

2. For the avoidance of doubt:

(a) the requirements set out in Appendices 7, 8, 14, 15, 16 and 17 to Schedule 2.1 shall be deemed to have been fulfilled where Infraco has achieved Practical Completion in relation to the relevant works; and
(b) achievement of Practical Completion shall be required together with the conditions as set out in Appendices 9A, 9B and 9C as a prerequisite for Delivery into Service and the existence of Snagging Items shall not prevent Delivery into Service.
3. For the purposes of paragraphs 4 to 9 only, " Practical Completion " means completion of the whole of the relevant works as described in the relevant Works Package Plan, so that they are available to be taken into use by LUL or Infraco ( as the case may be ) and are in a safe condition. Practically Complete shall be construed accordingly.
4. The requirements set out in Appendix 15A to Schedule 2.1 shall be deemed to have been fulfilled where Infraco has achieved Practical Completion in relation to the relevant works.
5. Infraco shall provide to LUL fourteen (14) days advance notice in writing of the date upon which it genuinely considers Practical Completion of the works described in the Work Package Plan(s) developed in relation to the applicable obligation will be achieved. Where Infraco reasonably considers that it will not be able to achieve Practical Completion by the advised anticipated date it shall so advise LUL in writing together with notice of the revised date by which Infraco genuinely considers it will achieve Practical Completion, and shall continue to do so until Practical Completion is in Infraco's opinion achieved.
6. When Infraco considers that it has achieved Practical Completion it shall notify LUL forthwith in writing.
7. LUL may in its discretion inspect the relevant works anytime after receipt of the first advance notice referred to in paragraph 5 above, and shall ( acting reasonably ) advise Infraco in writing as to whether it agrees that the works are Practically Complete within fourteen (14) days after receipt of the notification referred to in paragraph 6 above.
8. Where LUL advises Infraco that LUL does not accept that the works are Practically Complete, it shall at the same time provide to Infraco the reasons why Practical Completion has not been achieved, in which case Infraco shall repeat the requirements set out in paragraph 6 until Practical Completion is achieved.

9. For the avoidance of doubt:

(a) the requirements set out in Appendix 15A to Schedule 2.1 shall be deemed to have been fulfilled where Infraco has achieved Practical Completion in relation to the relevant works; and
(b) achievement of Practical Completion shall be required together with the conditions as set out in Appendix 9B and 9C as a prerequisite for Delivery into Service."

APPENDIX 9A - TRAIN CONDITIONS

1. APPLICATION OF APPENDIX 9
If Infraco intends to Deliver into Service any: (a) enhancements to Train Facilities; or

(b) new Train Facilities ( which may or may not replace existing Train Facilities )
and this Appendix 9A and Appendix 9C are prescribed to apply in accordance with paragraph 1.9 of this Schedule 2.1, such new or enhanced Train Facility shall only be considered to have been Delivered into Service if the conditions set out in paragraph 2 below have been satisfied and the procedure set out in Appendix 9C ( Conditions Procedure ) has been complied with.

2. CONDITIONS

2.1 In the case of enhancements specified in Appendices 7 ( Enhancements to Train Facilities ), 8 ( Refurbishment of Trains and Staff Accommodation ) and 18 ( Transition Projects ), such enhancements shall comply with the requirements set out in those Appendices, and such requirements shall be deemed to have been complied with once Practical Completion has been achieved in relation to the relevant enhancement.
2.2 In the case of a Specified Line Upgrade, such Specified Line Upgrade meets or exceeds the Journey Time Capability target score set out in column 2 of Table 1 of Appendix 3 of Schedule 4.1 of the PPP Contract ( Performance Payment Mechanism ) as confirmed by the testing and measurement procedures set out in Schedule 2 of the Performance Measurement Code ( Capability Testing and Measurement Procedures ) or as otherwise required elsewhere in this document.
2.3 All documentation ( manuals/records etc. ) reasonably necessary to enable LUL to operate the new or enhanced Train Facilities have been delivered.
2.4 All Category 1 Standards and Category 2 Standards and Draft Category 1 and Draft Category 2 Standards as set out in the Identified Standards Gap List have been complied with or concessions agreed in accordance with Clause 9 of the Service Contract.
2.5 All statutory and regulatory approvals have been obtained, provided that LUL shall exercise its statutory and regulatory powers to assist Infraco to obtain such approvals, but only: (a) to the extent LUL is able;

(b) where Infraco has provided all information and satisfied all obligations and otherwise established to the satisfaction of LUL ( acting reasonably ) that any such application for statutory and/or regulatory approval can properly be made; and
2.6 All data outputs ( e.g. performance data/Customer information ) reasonably necessary to enable LUL to operate the new or enhanced Train Facilities are available at required levels.
2.7 All relevant LUL Staff and Infraco Staff have been trained as required by Schedule 5.5 ( Training ).

APPENDIX 9B - STATION CONDITIONS

1. APPLICATION OF APPENDIX 9
If Infraco intends to Deliver into Service any: (a) enhancements to Station Facilities; or

(b) new Station Facilities ( which may or may not replace existing Station Facilities ),
and this Appendix 9B and Appendix 9C are prescribed to apply in accordance with paragraph 2.8 of this Schedule 2.1, such new or enhanced Station Facility shall only be considered to have been Delivered into Service if the conditions set out in paragraph 2 below have been satisfied and the procedure set out in Appendix 9C ( Conditions Procedure ) has been complied with.

2. CONDITIONS

2.1 In the case of enhancements specified in Appendices 14 ( Enhancement to Station Facilities ), 15 ( Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment ), 15A ( Tactile Installation Works and Platform Resurfacing Works ), 16 ( Station Accessibility Projects ), 17 ( Additional Projects ) and 18 ( Transition Projects ), such enhancements comply with the requirements set out in those Appendices, and such requirements shall be deemed to have been complied with once Practical Completion has been achieved in relation to the relevant enhancement.
2.2 The Station is Available in accordance with the revised Station Layout Plan referred to in Appendix 12 ( Station Plans ) ( e.g. no Routeways closed due to works etc. ).
2.3 All documentation ( manuals/records etc. ) reasonably necessary to enable LUL to operate the new or enhanced Station Facilities have been delivered.
2.4 All Category 1 Standards and Category 2 Standards and Draft Category 1 and Draft Category 2 Standards as set out in the Identified Standards Gap List have been complied with or concessions agreed in accordance with Clause 9 of the Service Contract.
2.5 All statutory and regulatory approvals have been obtained, provided that LUL shall exercise its statutory and regulatory powers to assist Infraco to obtain such approvals, but only: (a) to the extent LUL is able;

2.7 All relevant LUL Staff and Infraco Staff have been trained as required by Schedule 5.5 ( Training ).

APPENDIX 9C - CONDITIONS PROCEDURE

1 Infraco shall submit documents and/or information to LUL relating to the Delivery into Service of new or enhanced Facilities in accordance with the Assurance Plan and applicable PPP Contract requirements set out in paragraphs 1.9 and 2.8 of this Schedule 2.1 ( Service Outputs ).

2 Such documents and/or information shall, as a minimum, identify:

(a) how Infraco will comply with the applicable requirements of Appendix 9A or Appendix 9B;
(b) where the new or enhanced Facilities are those described in Appendix 7 ( Enhancements to Train Facilities ), Appendix 8 ( Refurbishment of Trains and Staff Accommodation ) but excluding those described in Part 4 of Appendix 8 ( Refurbishment of Train Staff Accommodation ) or Appendix 14 ( Enhancements to Station Facilities ), but excluding Station gardens as referred to in paragraph 14 of Appendix 14B, the Acceptance Testing to be carried out by Infraco and, in respect of each stage of any Acceptance Testing carried out by Infraco, the Acceptance Level achieved;
(c) what assessments Infraco has made of the likely environmental impacts of the new or enhanced Facilities and how Infraco proposes to avoid or mitigate any such impacts;
(d) what assessments Infraco has made of the likely impacts of the new or enhanced Facilities and their Delivery into Service on LUL's costs of operating the Underground Network and how Infraco proposes to avoid or mitigate any such costs;
(e) linkages to the planning process set out in Schedule 5.2 of the PPP Contract;
(f) linkages to the Risk Management Plan; and
(g) linkages to those parts of the safety arrangements addressing the Delivery into Service of new or enhanced Facilities.
3 Unless otherwise agreed by LUL, acting reasonably, Acceptance Testing shall apply to all Facilities referred to in paragraph 2(b) of this Appendix 9C.

7 Where LUL is required by this Appendix 9C to act reasonably in relation to any aspect of Acceptance Testing, LUL shall have regard to: (a) any relevant recent research carried out by Infraco, BCV or SSL which is drawn to its attention by Infraco;

(b) any relevant recent published or publicly available research which is drawn to its attention by Infraco; and

(c) any constraints imposed by Standards
and shall not require Infraco to carry out Acceptance Testing in respect of an Asset which is identical to an Asset already in use on the Underground Network or which cannot reasonably be expected materially to: (i) improve acceptability of design to, or overall satisfaction levels of, Customers;

(ii) improve functionality of the Facilities; or

( iii ) reduce or eliminate any detrimental effect on other services or Facilities
and in respect of any request by Infraco to modify Acceptance Testing as contemplated by paragraphs 3, 5 and 6 above, LUL shall respond to Infraco within such time as is reasonable in the circumstances.

APPENDIX 10 - Training Simulators
Train cab simulators at Edgware Station and Neasden Service Control Centre shall be made Available by Infraco for training purposes if requested by LUL.

Infraco shall make Available a Train cab simulator for training purposes in respect of any new types of Rolling Stock.

All Train cab simulators shall be maintained and upgraded to reflect any modifications that may occur to the relevant Rolling Stock as set out in Schedule 5.5 of the PPP Contracts ( Training ).

APPENDIX 11 - Station Availability

APPENDIX 11A - Station Opening Hours
The Station Opening Hours for each Station ( and, where applicable, for each Non-JNP Station ) shall be determined by Infraco from information contained in the Station Times Book.

The information contained in the Station Times Book which is used by Infraco to determine Station Opening Hours may be amended by LUL ( acting reasonably ) from time to time, but only to the extent necessary to reflect changes made to the Working Timetables in accordance with paragraphs 1.2.7 and 1.2.8 of this Schedule 2.1.

Any other information contained in the Station Times Book which is not necessary to determine such Station Opening Hours shall not be contractually binding on Infraco and may be amended by LUL ( acting reasonably ) from time to time for whatever reason.

APPENDIX 14 - Enhancements to Station Facilities

APPENDIX 14A - Scope and delivery of enhancements

1. SCOPE OF ENHANCEMENTS

1.1 Infraco shall Deliver into Service the general enhancements in respect of Station Facilities set out in Appendix 14B ( General Enhancement Requirements ).
1.2 Infraco shall Deliver into Service the specific enhancements in respect of Station Facilities at the Stations specified in Appendix 14C ( Specific Enhancement Requirements ) where such enhancements would otherwise not be required to be carried out under the general provisions of Appendix 14B ( General Enhancement Requirements ).
1.3 The Station categorisations are set out in Appendix 19 ( Station Categorisation ).

2. DELIVERY OF ENHANCEMENTS

2.1 In relation to each Station, Infraco shall Deliver into Service the enhancements set out in this Appendix 14 by the date of the first Periodic Review unless works to effect a Station Modernisation, Enhanced Station Refurbishment or Station Refurbishment ( as defined in Appendix 15 ) are required to be carried out at a Station by a Modernisation, Enhanced Refurbishment or Refurbishment Completion Date ( as defined in Appendix 15 ) which is prior to this date, in which case, enhancements shall be Delivered into Service at that Station by such Modernisation, Enhanced Refurbishment or Refurbishment Completion Date as required by paragraph 2.1(a), 3.1 and 4.1 of Appendix 15.
2.2 To the extent that Delivery into Service of the enhancements set out in this Appendix results in a change to the details set out in the tables in Appendix 11 ( Station Availability ) or Appendix 13 ( Station Facilities ), those tables shall be amended accordingly.

APPENDIX 14B - General Enhancement Requirements

1. TIME DISPLAY

1.1 The time shall be shown in twenty-four (24) hour digital format in every Ticket Hall and on every platform of every Station and shall meet the requirements set out in paragraphs 1.2 to 1.4 below.
1.2 On platforms, the time shall be visible and able to be read from the middle of the platform and from all platform entrances and may be shown by a dedicated clock and/or as part of an Visual Electronic Information Display Panel ( referred to in paragraph 6 below ).
1.3 In Ticket Halls, the time shall be visible and able to be read from each Ticket Hall entrance.
1.4 Where a Station is statutorily listed or has Railway Heritage Features, there may be a requirement to retain or provide analogue clocks. In such cases, this requirement shall be observed by Infraco in carrying out enhancement works.

2. SEATS

2.1 On each platform of every Station, except those platforms at Willesden Green, Neasden, Golders Green and Wembley Park Stations which are not normally required in Station Service, seating for a minimum of twenty-four (24) people shall be provided. Seats inside Enclosed Waiting Areas shall be included within this total, but seats inside waiting rooms shall not be included. Seats shall be distributed in groups along the length of the platform.

3. TOILETS

3.1 Existing Customer toilet facilities shall be retained. Those which are closed at the Transfer Date shall be reopened or, to the extent possible without substantially changing the existing structure of the Station, shall be replaced by a new facility at the same Station.
3.2 At Stations which have a step-free route for Customers between the street outside the Station entrance and each platform of that Station and between each platform at that Station, toilets ( where they exist ) are to be made fully accessible to mobility-impaired Customers. Any newly-built toilets for mobility-impaired Customers shall be unisex, with an entrance separate from the male and female toilets.

4. "NEXT LIFT" SIGNS AND AUDIBLE MESSAGES

4.1 At each Station where there is a bank of two (2) or more lifts, illuminated "Next Lift" signs and equivalent audible messages shall be provided at each lift landing and adjacent to each lift to enable Customers to know from a distance the position of each lift in the shaft and which lift will be the next to depart.

5. ELECTRONIC VISUAL EMERGENCY INFORMATION INDICATOR

5.1 There shall be an electronic visual emergency information indicator on the exterior of each street entrance to each Station which meets the requirements of paragraph 5.2 below.
5.2 The indicator shall have the minimum functionality of: (a) conveying information necessary to prevent Customers entering the Station; and

(b) emitting an audible emergency sound and flashing lights.

6. TICKET HALL VISUAL ELECTRONIC INFORMATION DISPLAY PANEL

6.1 There shall be at least one (1) Visual Electronic Information Display Panel present in each Ticket Hall at each Station where required by the applicable Standards which meets the requirements of paragraphs 6.2 and 6.3 below.
6.2 To the extent possible given the existing Station layout, each Display Panel shall be located so that Customers: (a) are able to see the information displayed once they have entered the Station but before they make a ticket purchase; and

(b) are not encouraged to stop to view the Display Panel in places which would result in the flow of Customers into or out of the Station becoming obstructed.
6.3 Each Display Panel will have the minimum functionality of showing: (a) the expected number of minutes before the arrival of the next Train to each available destination from that Station;

(b) the platform number from which the Train concerned will depart;

(c) the routing of the Train ( especially where the applicable Line has branches );

(d) the time;

(e) messages generated locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be specified by LUL;

(f) Station and network real time, emergency and service disruption information; and

(g) static, flashing and scrolling textual information and symbols.

7. PLATFORM VISUAL ELECTRONIC INFORMATION DISPLAY PANEL

7.1 At all Stations there shall be at least one Display Panel present on each platform which is served by a Train so as to meet the requirements set out in paragraph 7.2. For this requirement, an island platform shall be considered as being two separate platforms. The Display Panel shall be positioned so that Customers shall be able to see the Display Panel and read the information on it from the middle of the platform and from the platform entrances. If this cannot be achieved by providing one Display Panel per platform then more than one shall be provided in order that the requirements set out in the previous sentence are met.
7.2 Each Display Panel shall have the minimum functionality of showing: (a) the destination and expected number of minutes before arrival of the next three (3) Trains arriving at each platform;

(b) the destination and expected number of minutes before arrival of the subsequent Train arriving at each platform if the destination of that subsequent Train is not served by any of the three (3) Trains referred to in (a) above;

(c) the routing of the Train ( especially where the Line branches );

(d) the time;

(e) messages generated locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be specified in LUL;

(f) Station and network real-time, emergency and service disruption information; and

(g) static, flashing and scrolling textual information and symbols.

8. AUDIBLE INFORMATION IN EACH TICKET HALL, PLATFORM AND ROUTEWAY

8.1 It shall be possible for live and pre-recorded announcements to be made via a Public Address System to Customers and Staff in every Ticket Hall, platform and Routeway of each Station with announcements able to be generated locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be specified by LUL.
8.2 The pre-recorded announcements shall be made using an Automated Voice Announcer.
8.3 It shall be possible for pre-recorded announcements made by the Automated Voice Announcer to be: (a) overridden if necessary; and

(b) timed to enable announcements not to be broadcast as a Train is arriving at or leaving the platform and whilst an automatic announcement is being made on a Train which has stopped at a platform and has its doors open.
8.4 Announcements shall be capable of being heard through the provision of induction driven "hard of hearing" loops by Customers using hearing aids which are capable of responding to induction loop signals: (a) in each Ticket Hall at every Station; and

(b) on each platform and in every Routeway at each category A Station as determined in accordance with Appendix 19 ( Station Categorisation ).
8.5 The Automated Voice Announcer in such areas of a Station shall have the minimum functionality of automatically announcing information including: (a) the name of the Station;

(b) information relevant to that Station regarding interchange facilities with other Lines and with the National Railway Network;

(c) the name of the next Station at which the Train will call;

(d) requests not to smoke;

(e) requests not to leave items unattended in the Station;

(f) requests for Customers to take litter home with them;

(g) security and Station evacuation messages; and

(h) when the Train doors open at Stations where there is either a vertical or horizontal gap of six (6) inches or more between the Train step and the platform edge, giving the warning "Please mind the gap between the Train and the platform".
8.6 Ambient noise detection shall be provided such that the volume of an announcement is adjusted automatically to take account of the level of ambient noise so that the announcement can be heard clearly.
8.7 It shall be possible for Staff to make announcements over the Public Address System whilst on any platform by using a fixed microphone at a public address announcement point in that platform and in any part of a Station by using a hand-held microphone linked by radio ( or such other means ) to the Public Address System.

9. AUDIBLE INFORMATION IN EACH LIFT

9.1 Where lifts exist, it shall be possible for live and pre-recorded announcements to be made via a Public Address System to Customers and Staff in every lift with announcements able to be generated locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be specified by LUL.
9.2 The pre-recorded announcements shall be made using an Automated Voice Announcer ( as defined in paragraph 8 above ).
9.3 In each lift, announcements shall be capable of being heard through the provision of induction driven "hard of hearing" loops by Customers using hearing aids which are capable of responding to induction loop signals:
9.4 The Automated Voice Announcer in each lift shall have the minimum functionality of automatically announcing information including: (a) a warning to Customers when the lift doors are about to close;

(b) requests that Customers have their tickets ready as the lift approaches the Ticket Hall level; and

(c) Station-specific information including information about how to exit the Station and the names of the major landmarks and tourist attractions served by that Station.

10. MIRRORS

10.1 Convex metallic mirrors of solid construction shall be installed at all Stations ( subject to architectural and heritage considerations ) where blind corners, recesses, wide pillars and other obstructions exist to break a reasonable sight-line of the Customer moving through the Station.

11. SECURITY MONITORING EQUIPMENT

11.1 All Stations shall be equipped with security monitoring equipment which meets the requirements of paragraphs 11.2 to 11.3 below such that there is full security monitoring of: (a) each Ticket Hall, including each Station exit, dark pathways and car park access routes;

(b) each Routeway including each lift at Stations where a lift is provided; and

(c) each platform.
11.2 The security monitoring equipment shall: (a) be sited in positions best suited to avoid being damaged or obscured;

(b) be constructed in such a way as to reduce the possibility of vandalism;

(c) have associated monitoring equipment which:
(i) indicates that the security monitoring equipment is functional;

(ii) enables LUL Staff in the Station Control Room or other control location to view the image(s) that are being produced by the security monitoring equipment ( view(s) to be selectable for continuous or scanning sequence display ); and

( iii ) will automatically display the image(s) produced by the security monitoring equipment when an emergency help facility has been operated;

(d) have recording equipment that is able to record images of a suitable quality to assist in the prosecution of criminal offenders;

(e) produce colour images which can be enhanced by others for identification purposes in order to assist in the prosecution of criminal offenders; and

(f) have the functionality to be controlled and monitored locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be reasonably specified by LUL.
11.3 At least one (1) monitor screen for Customers to view shall be installed at each Station in the Ticket Hall. The monitor(s) shall be positioned such that Customers passing through the ticket gateline can see that they are being observed but without obstructing the flow of pedestrians. A sign shall be affixed to each monitor indicating that the images displayed are being monitored and recorded and that they can be used to assist in the prosecution of criminal offenders.

12. EMERGENCY HELP FACILITIES

12.1 Emergency help facilities ( which shall meet the requirements of paragraph 12.2 below ) shall be installed at each Station as follows: (a) one (1) emergency help facility in each Ticket Hall;

(b) one (1) emergency help facility in each Routeway area, including concourses, circulating areas and passageways including inside each lift at Stations where lifts are provided; and

(c) three (3) emergency help facilities on each platform.
12.2 An emergency help facility shall: (a) be immediately recognisable as such;

(b) at Stations which have fire alarm systems, incorporate the fire alarm unit;

(c) have the functionality to be controlled and monitored locally at the Station and remotely from a Station Control Room and/or Line Control Room and/or other remote location as may be specified by LUL;

(d) be observed by security monitoring equipment which will automatically be activated when the emergency help facility is operated and immediately and automatically provide the member of LUL Staff in the Station Control Room with a view of what is happening;

(e) be at a height such that it is able to be reached and operated by Customers sitting in wheel-chairs;

(f) be able to be used by Customers using hearing aids capable of responding to induction loop signals;

(g) in the Ticket Hall and on the platform, as far as reasonably practicable, be clearly visible to a Customer entering the Ticket Hall or platform;

(h) in the Ticket Hall, be installed on the unpaid side of the ticket gateline;

(i) on the platform, be spaced out at intervals along the platform; and

(j) display an indication that the facility is operational such that the Customer does not have to find this out by using it.

13. BICYCLE FACILITIES

13.1 At each Station, where land adjoining the Station entrance and leased to Infraco is available or space is available in the Station building at ground level, bicycle racks or secure bicycle lockers ( Bicycle Facilities ) enabling the storage of bicycles by Customers and LUL Staff shall be provided which meet the requirements of paragraph 13.2 below.
13.2 All Bicycle Facilities shall: (a) be positioned in a highly-visible location convenient for the Station entrance but without disrupting pedestrian flow into and out of the Station;

(b) be kept in a good state of repair;

(c) be well lit;

(d) have a permanent sign highlighting their position;

(e) have a disclaimer notice which states that bicycles are left at the owner's risk; and

(f) be monitored by security monitoring equipment.

14. STATION GARDENS

14.1 All Station gardens which currently exist shall be retained for use by LUL Staff.

15. STATION CONTROL ROOMS

15.1 All Stations shall be linked to a Station Control Room, which shall be located either at the Station concerned or at another site to be specified by LUL.
15.2 A Station Control Room shall have the minimum functionality of controlling and monitoring electronic visual emergency information indicators, Ticket Hall Visual Electronic Information Display Panels, platform Visual Electronic Information Display Panels, Public Address Systems, security monitoring equipment and emergency help facilities to the levels of functionality described elsewhere in this Appendix 14. In addition, a Station Control Room shall have the minimum functionality of monitoring the status of lifts, escalators and Customer conveyors.
15.3 To the extent that it is reasonably possible without substantially changing the existing structure of the Station, each Station Control Room shall be located so that it is visible to the Customers.
15.4 Station Control Rooms shall not be accessible to Customers.

16. CABLE MANAGEMENT SYSTEM

16.1 A Cable Management System shall be provided at each Station with adequate spare capacity to cater for an additional usage of thirty per cent. ( 30% ) over and above the usage required on installation. Cable Management System means a system enabling, as far as practicable, cables not to be attached directly to walls or ceilings but to be hidden from public view or to be positioned as unobtrusively as possible.

17. WAITING ROOMS AND ENCLOSED WAITING AREAS

17.1 All existing waiting rooms for Customers on platforms shall be retained.
17.2 On each platform ( or island platform ) at each Station ( except for those platforms at Willesden Green, Neasden, Golders Green and Wembley Park Stations which are not normally required in Station Service ) which is not a Section 12 Station and where there is not currently a waiting room, an Enclosed Waiting Area shall be provided which meets the requirements of paragraph 17.3 below.
17.3 Enclosed Waiting Area means a waiting area for use by Customers when waiting for Trains which shall: (a) be constructed from clear glazing ( where practically and physically possible ) or from other similar materials so as to enable Customers to view what is happening in the waiting area whilst offering protection for Customers from the weather;

(b) be lit to the Standards specified for platform areas;

(c) be monitored by security monitoring equipment;

(d) contain seats;

(e) be maintained at a comfortable temperature by the provision of heaters; and

(f) contain an emergency help facility.
17.4 Where reasonably practicable, access to the Enclosed Waiting Area on a platform from the Ticket Hall shall be protected by a canopy.

18. WAITING AREAS IN TICKET HALLS

18.1 Where there is space available, a waiting area shall be provided in each Ticket Hall which shall: (a) have a minimum of four (4) seats;

(b) be observed by security monitoring equipment;

(c) be the location for an emergency help facility;

(d) be the location for a Ticket Hall visual electronic information display; and

(e) be located in a visible position such that the area can be observed by LUL Staff on the gateline when the Station is staffed.

APPENDIX 15 - Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment

1. General

1.1

In this Appendix 15, the following expressions have the following meanings:
Enhanced Refurbishment Completion Date
means each date specified in the column of the table in paragraph 6 below headed "Enhanced Refurbishment Completion Date - to be completed by the date specified";
Enhanced Station Refurbishment means a package of works undertaken to a Station by the relevant Enhanced Refurbishment Completion Date in order to enhance ambience, reduce future maintenance costs and ensure that there is no insidious decline in the condition of the Station. Such works shall include those specified in the list in paragraph 5 below but incorporate a more extensive renewal of floor, wall, ceiling and staircase finishes than delivered by a Station Refurbishment, the scope of which will be agreed with LUL in accordance with paragraph 7 of Schedule 3.1 and whose consent shall not be unreasonably withheld;
Modernisation Completion Date
means each date specified in the column of the table in paragraph 6 below headed "Modernisation Completion Date - to be completed by the date specified";
Refurbishment Completion Dates means each date specified in the column of the table in paragraph 6 below headed "Refurbishment Completion Dates - to be completed by the date specified";

means a major upgrade to a Station which will result in that Station:

(a) being considered to be fit for purpose;
(b) embracing technology in accordance with current industry practice; and
(c) lasting ( with Station Refurbishments being carried out by the relevant Refurbishment Completion Dates in accordance with this Appendix 15 and an annual maintenance and cleaning regime ) for forty (40) years,

and the works to effect such upgrade shall comprise those specified in paragraphs 2 and 5 below but it is acknowledged by both parties that where duplication of particular work occurs, paragraph 2 shall take precedence; and
Station Refurbishment
means a package of works undertaken to a Station by the relevant Refurbishment Completion Dates to ensure that there is no insidious decline in the condition of the Station and that where a Station Modernisation has been undertaken pursuant to the PPP Contracts, the quality achieved by such Station Modernisation is restored and such works shall comprise those specified in the list in paragraph 5 below.
1.2 Subject to paragraph 1.3 below, Infraco shall carry out the Station Modernisations described in paragraph 2 below at each Station by the Modernisation Completion Date specified in the list in paragraph 6 below.
1.3 Where no Modernisation Completion Date is specified in the table in paragraph 6 in relation to a particular Station, Infraco is not required to carry out any Station Modernisation at that Station.
1.4 For the avoidance of doubt, at certain Stations, Station Modernisations and Station Refurbishments may form Transition Projects which are being, or will be, carried out at those Stations. This Appendix 15 should therefore be read in conjunction with Appendix 18 ( Transition Projects ).
1.5 Infraco shall carry out the Enhanced Station Refurbishment and Station Refurbishments specified in the list in paragraph 5 below at each Station in accordance with the Refurbishment Completion Dates specified in the tables in paragraph 6 below.
1.6 Notwithstanding the provisions of this Appendix 15, LUL shall, at the request of Infraco, agree that certain Station Modernisation, Enhanced Station Refurbishment or Station Refurbishment works need not be carried out, agree to changes being made to the scope of works that this Appendix 15 requires Infraco to carry out or agree to changes in the timing of completion of such works Provided that Infraco can demonstrate to the satisfaction of LUL that: (a) repair, replacement or other works had been carried out within the three (3) year period prior to the relevant Latest Completion Date and such works were equivalent to those which Infraco is required to carry out under this Appendix 15; or

(b) specific Station Facilities or finishes which require refurbishment, modernisation or enhanced refurbishment are in good order and fit for purpose and, therefore, Station Refurbishment, Station Modernisation or Enhanced Station Refurbishment works are not required in relation to such Station Facilities or finishes; or
Provided that Infraco can demonstrate to the satisfaction of LUL that such changes to the works, scope or timing of works required would result in reduced Customer disbenefit ( by use of the appraisal methodology which is described in the Business Case Development Manual ).
1.7 In carrying out Station Modernisation, Enhanced Station Refurbishment and Station Refurbishment works, Infraco shall ensure that when such works have been completed, there is consistency of decor, quality and condition with no obvious "tide-marks" between those Station Facilities, parts of Station Facilities or areas within a Station, which have been the subject of works and those which have not been the subject of works.
1.8 As part of the Work Package Planning stage of each Station Modernisation, Enhanced Station Refurbishment or Station Refurbishment LUL will decide whether it requires Infraco to include as part of the relevant Station Modernisation, Enhanced Station Refurbishment or Station Refurbishment, the refurbishment of the retail shop fronts of any Commercial Property ( within the Premises ) at the relevant Station in which case the provisions of paragraph 7.2.3 of Schedule 1.5 will apply.

1.9 Provisions relating to Listed and Other Significant Buildings

1.9.1 Where a Station is a listed building, has a local authority listing, is in a conservation area or has Railway Heritage Features, Infraco shall have regard to the need for a different approach to: (a) the works which will be carried out to effect a Station Modernisation, Enhanced Station Refurbishment or Station Refurbishment; and

(b) notwithstanding the categorisation given to the particular Station pursuant to Appendix 19 ( Station Categorisation ) the quality of finish and/or materials used in such works
for the purposes of ensuring that the Station's architectural and design integrity is maintained.
1.9.2 If Infraco proposes to adopt a different approach in circumstances as described in paragraph 1.9.1 above or if Infraco proposes to remove or replace existing fixtures or fittings which support the Station's architectural and design integrity it shall notify LUL of such intentions, giving LUL a reasonable opportunity to comment in advance of the commencement of any works.

2. STATION MODERNISATION

2.1 The works to effect a Station Modernisation shall include, but not be limited to, the following:

(a) renewal of existing, or the provision of new, Station Facilities and Delivery into Service of the enhancements to Station Facilities specified in Appendix 14 ( Enhancements to Station Facilities ) if such enhancements have not been Delivered into Service by the applicable Modernisation Completion Date;

(b) renewal of floor, wall, ceiling and staircase finishes to enhance ambience and reduce future maintenance costs;

(c) removal of any hazardous materials;

(d) to the extent that is reasonably possible without substantially changing the existing layout or structure of the Station, minimisation or removal of obstructions to the flow of Customers;

(e) major structural repairs ( where these are necessary );

(f) rationalisation of information and secondary revenue areas into zones in order to make them readily distinguishable from each other so that Customers can easily identify information;

(g) relighting;

(h) renewal of electrical and mechanical, fire protection and communication assets;

(i) renewal of doors and ironmongery, including key suiting covering the Station concerned;

(j) renewal of Signage;

(k) renewal of seating, toilets, waiting rooms, Enclosed Waiting Areas, where these exist;

(l) measures to prevent water ingress where such water ingress has a deleterious effect on surface finishes, is liable to corrosion or loss of structural integrity or to cause unpleasant smells;

(m) repairs to platform and cross-passage inverts;

(n) renew or repair Customer Facing External Surfaces and other external structures and features where these exist, including facade, canopies, glazing, roof and platform canopies;

(o) renewal of Staff Accommodation;

(p) removal of redundant Facilities, machinery, equipment, fixtures and fittings;

(q) specifically to assist the mobility-impaired, the installation of or improvements to handrails, stairs, tactile floor surfaces, and the highlighting of obstructions; and

(r) renewal, upgrading or installation of supporting infrastructure as necessary to enable LUL to undertake LUL Commercial Exploitation. During the planning phase of these works, LUL and Infraco shall agree the scope of works to be Delivered into Service. For the avoidance of doubt, the cost of these works will be included within the aggregate £500,000 per Contract Year set out in paragraph 29.2 of the Service Contract. For the purpose of clarity, such infrastructure to include Utilities and Utilities Equipment.

2.2 The quality of the finish and the quality of the materials used in a Station Modernisation for a particular Station shall be dependent upon the categorisation given to the Station in accordance with Appendix 19 ( Station Categorisation ):

(a) category A Stations shall be finished using materials and components such as vitreous enamel or marble wall panels or ceramic or other tiling, terrazzo or other floor tiling, vitreous enamel or other ceiling panels or other materials and components of a similar quality and standard;

(b) category B Stations shall be finished using materials and components, such as the more extensive use of ceramic tiling for wall finishes; and

(c) category C Stations which are below ground level shall be finished using materials and components such as the use of ceramic tiling or similar materials for wall finishes.

Where category C Stations are at ground level or above, these shall be finished using materials and components such as the more extensive use of painted timber and steelwork, concrete paving or tiled floor finishes and walls with facing brickwork finishes or other materials and components of a similar quality and standard.
2.3 At any category of Station it is not expected that existing vitreous enamel or brick finishes will be replaced unless such finishes are damaged or are defective.

3. ENHANCED STATION REFURBISHMENT

3.1 The work to effect the first Enhanced Station Refurbishment, by the relevant Enhanced Refurbishment Completion Date, shall include renewal of existing, or the provision of new Station Facilities and Delivery into Service of the enhancements to Station Facilities specified in Appendix 14 ( Enhancements to Station Facilities ) if such enhancements have not been Delivered into Service by the applicable Enhanced Station Refurbishment Completion Date.

4. STATION REFURBISHMENT

4.1 The work to effect the first Station Refurbishment, by the relevant Refurbishment Completion Date shall include renewal of existing, or the provision of new Station Facilities and Delivery into Service of the enhancements to Station Facilities specified in Appendix 14 ( Enhancements to Station Facilities ) if such enhancements have not been Delivered into Service by the applicable Refurbishment Completion Date.

5. ENHANCED STATION REFURBISHMENT AND STATION REFURBISHMENT CYCLE TABLE The list below describes the works to be carried out as part of each Enhanced Station Refurbishment or Station Refurbishment.

5.1 Ticket Hall and ancillary areas ( including access subways and other access routes ): (a) Paint and redecorate;

(b) Repair / replace damaged wall, floor and ceiling finishes;

(c) Replace rubber flooring to Ticket Office and Station Control room;

(d) Refurbish / replace seating ;

(e) Anti-carbonisation treatment to concrete as necessary;

(f) Refurbish/repair/replace doors & ironmongery, including key suiting/ advertising panels/windows/other glazing/Station entrance canopies;

(g) Renew treads, nosings and handrails to staircases;

(h) Refurbish / renew Signage;

(i) Waterproofing - prevention of water ingress where such water ingress has a deleterious effect on surface finishes, is liable to cause corrosion or loss of structural integrity or cause unpleasant smells.
5.2 Escalator shaft: (a) Waterproofing - Prevention of water ingress where such water ingress has a deleterious effect on surface finishes, is liable to cause corrosion or loss of structural integrity or to cause unpleasant smells;

(b) Paint & redecorate;

(c) Repair / replace damaged wall, floor and ceiling finishes;

(d) Renew treads, nosings and handrails to staircases;

(e) Repair / replace advertising panels;

(f) Refurbish / renew Signage.
5.3 Routeways, concourses, stairs, passages, footbridges and subways: (a) Paint & redecorate;

(b) Repair/replace damaged wall, floor and ceiling finishes;

(c) Waterproofing - Prevention of water ingress where such water ingress has deleterious effect on surface finishes, is liable to cause corrosion or loss of structural integrity or cause unpleasant smells;

(d) Refurbish / repair / replace doors & ironmongery, including key suiting;

(e) Anti-carbonisation treatment to concrete as necessary;

(f) Repair/replace advertising panels;

(g) Renew treads & nosings to staircases;

(h) Refurbish/renew Signage.
5.4 Platforms and cross passages ( including waiting rooms and Enclosed Waiting Areas ): (a) Paint & redecorate;

(b) Repair / replace damaged wall, floor and ceiling finishes;

(c) Waterproofing - Prevention of water ingress where such water ingress has a deleterious effect on surface finishes, is liable to cause corrosion or loss of structural integrity or cause unpleasant smells;

(d) Refurbish / repair / replace doors & ironmongery, including key suiting;

(e) Anti carbonisation treatment to concrete as necessary;

(f) Repair / replace advertising panels;

(g) Refurbish / renew Signage;

(h) Refurbish / replace seating / provide additional seating;

(i) Refurbish / replace head-wall and tail-wall units.
5.5 External Works: (a) Repair fences, roadway surfaces, bollards, bicycle facilities

(b) Cut back vegetation

(c) Clean out and repair gutters and rainwater pipework

(d) Glazing repairs / replace missing or cracked glass

(e) Refurbish / renew Signage

(f) Repair / replace advertising panels.
5.6 Other items: (a) Repair / renew asphalt or tiled roofs including flashings;

(b) Overhaul glazed roofs to ensure water-tightness;

(c) Silicone pointing replacement;

(d) Repair / renew cladding / metal louvers;

(e) Paint & redecorate timber facias, barge boards, etc.;

(f) Clean & apply anti graffiti paint to brick, stone & concrete surfaces;

(g) Repoint brickwork and stone;

(h) Paint exposed steelwork;

(i) Structural repairs ( where they are necessary );

(j) Repairs to inverts ( where necessary );

(k) Drainage inspection and maintenance;

(l) Repair/renew electrical and mechanical, fire protection and communications assets ( where necessary );

(m) Paint / redecorate / repair toilets ( where provided );

(n) Paint / redecorate / refurbish Staff Accommodation;
